Availability of US Discovery in International Arbitration

Chaffetz Lindsey associate Yasmine Lahlou authored an article on the applicability to international arbitration of 28 U.S.C. 1782 (“Article 1782”), a statute which allows discovery in the U.S. in support of proceedings abroad. Published in Les Cahiers de l’Arbitrage, a leading French journal on arbitration, the article examines the inconsistent decisions by the federal courts that have grappled with this issue, and highlights the complex strategic choices confronting both litigants and arbitral tribunals.
