December 2013 – Counsel Jennifer Gorskie co-moderated a discussion on developments in the law of sovereign immunity emerging from litigation prompted by Argentina’s 2001 sovereign bond default at an event organized by the International Law Committee of the New York City Bar Association. Chaffetz Lindsey associate Diego Guevara, who along with Jennifer is a member of the Committee, assisted in organizing the event.
The panel included Felix Salmon, a finance journalist for Reuters who covers sovereign default issues and Argentina in particular, Bruce Wolfson of Bingham McCutchen, Alex Yanos of Freshfields Bruckhaus Deringer, and Carmine Boccuzzi of Cleary Gottlieb. They discussed the outcome of the recent cases of BG Group v. Argentina and NML Capital v. Argentina, and the direction courts are likely to take on issues such as pari passu clauses, sovereign discovery, and judicial review of jurisdictional decisions by arbitrators.
Jennifer is a fluent Spanish speaker, who has spent much of her career focused on resolving international commercial disputes involving companies based in or investing in Latin America. Her experience includes representing the Argentine government as well as various Latin American energy, gas, and mining companies in commercial and investment treaty disputes. Diego is a native Spanish speaker who worked in the São Paulo office of Davis Polk before joining Chaffetz Lindsey in 2013.
