Smit-Lowenfeld Prize Awarded to Co-Authors Caline Mouawad Jessica Beess und Chrostin by International Arbitration Club of NY

February 2023— Chaffetz Lindsey’s Caline Mouawad and King & Spalding’s Jessica Beess und Chrostin were recently awarded the twelfth annual Smit-Lowenfeld Prize by the International Arbitration Club of New York for best article in the field of international arbitration. The article, titled “The Illegality Objection in Investor-State Arbitration,” methodically reviews investment awards that involved an illegality objection.  The Smit-Lowenfeld Prize is awarded annually by the International Arbitration Club of New York to recognize the outstanding article published in the previous year on any aspect of international arbitration. The Prize honors the late Hans Smit of Columbia Law School and Andreas F. Lowenfeld of New York University School of Law, both renowned scholars in international litigation and arbitration.

 

Chaffetz Lindsey’s Aníbal Sabater commendend Caline and Jessica for their work. “Caline is a phenomenal lawyer, with deep analytical skills and years of experience in investment cases,” Aníbal stated. “It is no surprise to see her and Jessica recognized for their trailblazing study on the illegality objection, which we wholeheartedly recommend our colleagues read. When presenting the award, Lawrence W. Newman, Presiding Member of the IACNY and Of Counsel at Baker McKenzie, stated: “This is an important article on a heretofore unexplored area of investment treaty arbitration scholarship—the responses of arbitration tribunals to assertions by host countries that claimant investors obtained their investments in violation of local law.”
