Yasmine Lahlou, Andy Frischknecht, and Thomas Hildebrand Publish Guidance Notes on Enforcing Awards Under the New York Convention with Kluwer

Where Advocacy Meets Business

October 2025 — Chaffetz Lindsey partners Yasmine Lahlou, Andreas Frischknecht, and Thomas Hildebrand have co-authored an updated and comprehensive Practical Insights guide on the enforcement of arbitral awards under the New York Convention. The guide, which includes new comparative notes on Articles III, IV, and V(1)(a), offers valuable practical guidance for practitioners dealing with the complexities of enforcing foreign arbitral awards worldwide.

The authors explore the procedural and evidentiary aspects of the enforcement process, emphasizing critical topics such as:

  • The presumption of enforceability and its impact on enforcement strategies.
  • The essential documents required for enforcement and the national rules that shape local procedures.
  • The importance of early consultation with local counsel to navigate jurisdictional nuances and maximize enforceability.

Additionally, the authors tackle Article V(1)(a), providing an in-depth examination of the grounds for non-enforcement, specifically focusing on the incapacity or invalidity of the arbitration agreement. This section provides practitioners with the knowledge to effectively resist or seek enforcement in a variety of jurisdictions.

The article, co-authored with Fabrizio Garbin (former Chaffetz Lindsey Foreign Associate), is designed to help arbitration counsel understand the intricacies of global enforcement, particularly the limits on procedural burdens that states can impose under Articles III and IV of the Convention.
