James Hosking and Marcel Engholm Co-Author Article for the Bahrain Chamber for Dispute Resolution International Arbitration Review

December 2023 – Chaffetz Lindsey’s James Hosking and Marcel Engholm contributed to the 14^th edition of the Bahrain Chamber for Dispute Resolution’s International Arbitration Review. Published biannually and featuring content in both Arabic and English, the Review comprises articles, case summaries and other significant reports; each issue focusing on a topic of universal interest in international arbitration with an emphasis on relevance to the Arab Region.

James and Marcel co-authored the article titled “The Central Importance of the Seat in Online Dispute Resolution”. The article discusses the authors’ view that while advances in remote hearing technology have liberated arbitrations from the shackles of geography, they may paradoxically have made the juridical seat of arbitration all the more important. The article discusses the main challenges arising in remote hearings and concludes that most are best resolved by reference to the law of the seat.
