June 2025– Chaffetz Lindsey’s James Hosking and Yasmine Lahlou have co-authored a new ICCA Practical Insights module on the right to a physical hearing in international arbitration, published in collaboration with Wolters Kluwer. The module was developed alongside co-author Giacomo Rojas Elgueta and edited by Kiran Nasir Gore, Joshua Karton, Simon Greenberg, and Fan Yang.
The publication offers clear, practical analysis of a still heavily debated issue in international arbitration —whether parties have a legal or implied right to an in-person hearing, and what the implications are when hearing formats are imposed over party objection.
Building on the findings of ICCA’s 2020 Right to a Physical Hearing project and its accompanying 2022 umbrella report, the new module synthesizes legal commentary and jurisdiction-specific insights to provide guidance on:
