International Litigation: Inbound Cross-Border Discovery Review in the Commercial and Federal Litigation Section Newsletter

August 2022 The 2022 summer edition of the New York State Bar Association’s Commercial and Federal Litigation Section newsletter highlighted the “International Litigation: Inbound Cross-Border Discovery” online event which took place May 3rd, 2022. The event was organized by the NYSBA International Litigation Committee, which is co-chaired by Clara Felbus and Chaffetz Lindsey’s Charles Scibetta.

The talk was the first of a multi-part CLE series aimed at increasing familiarity with procedural mechanisms to obtain evidence from individuals or entities located in jurisdictions different from where a proceeding is, or will be, pending. The dynamic panel, including Chaffetz Lindsey’s Alan Lipkin, Charlene Sun (DLA Piper) and Chris Paparella (Steptoe & Johnson), was moderated by Chaffetz Lindsey’s Gretta Walters. Alan led a discussion on Chapter 15 discovery mechanisms available to gather evidence in aid of, or in connection with, foreign insolvency, liquidation, or debt restructuring proceedings.
