Yasmine Lahlou and Andy Frischknecht Contribute to “International Commercial Arbitration with Sovereign States”

May 2026– Chaffetz Lindsey’s Yasmine Lahlou and Andy Frischknecht co-authored the introductory chapter of the newly published International Commercial Arbitration with Sovereign States, alongside former Chaffetz Lindsey Foreign Associate, Daniel Currea.

Their chapter, “States, Sovereignty, and International Law: A Voluntary Servitude?,” explores the historical evolution of state sovereignty and its relationship to international law, tracing developments from the Peace of Westphalia through the rise of globalization, multilateralism, and international investment law. They examine how the traditional concept of sovereign immunity has evolved over time and how modern international legal frameworks increasingly govern the relationship between States and private actors.

The chapter also analyzes the growing role of international arbitration and investment agreements in disputes involving sovereign States, highlighting the tension between state sovereignty and the obligations States voluntarily undertake through international treaties and commercial relationships.

Published by Edward Elgar Publishing, the book provides a comprehensive examination of international commercial arbitration involving sovereign States, addressing both public international law principles and practical considerations for resolving disputes with state entities.
