James Hosking Part of Faculty for Italian Course in International Arbitration

September 2014 – James Hosking was a lecturer for the newly offered certificate program in International Commercial and Investment Arbitration Theory and Practice run at Roma Tre Universita Degli Studi, and sponsored by the International Chamber of Commerce, Italian Arbitration Association, and Milan Chamber of Arbitration, from September 15 -19, 2014. The week-long course was attended by a mix of law students, practitioners and in-house counsel, and is intended as an intense introduction to international commercial and investment arbitration. The course was run in partnership with Cleary Gottlieb, NCTM Studio Legale Associato, arbit (the Italian Forum for Arbitration and ADR), and the Italian Ministry of Justice, and included faculty from the world’s leading international arbitration practices and institutions, and leading academics in the area. James spoke on extending the arbitration agreement to non-signatories.

Yasmine Lahlou is Appointed to ICC YAF Coordinating Committee

July 2014 – Counsel Yasmine Lahlou has been appointed to the International Chamber of Commerce (ICC) Young Arbitrators Forum’s (YAF) new Regional Coordinating Committee for 2014 – 2016. The Committee is tasked with promoting and developing the ICC YAF’s global network of 7,500 members, which includes organizing regional and global conferences on the latest developments in international arbitration. Yasmine is joined on the Committee by lawyers from some of the US’s most distinguished international arbitration practices, and her experience in the area is recognized by Chambers USA. Chaffetz Lindsey Team Wins Dismissal of Claims in Picasso Ownership Dispute

July 2014 – Partner Andy Frischknecht was quoted in the New York Law Journal, concerning a recent decision in the Southern District of New York dismissing all claims against the Free State of Bavaria in a dispute over ownership of a well-known painting by Pablo Picasso titled “Madame Soler.”

Andy, James Hosking and Andrew Poplinger represented Bavaria in the litigation.  At issue were claims by the heirs of a former owner of the painting against Bavaria, which acquired “Madame Soler” in the 1960s.  The heirs claimed superior title to the painting (which they valued at up to $100 million) based on the circumstances of a prior sale in the 1930s.  Following extensive briefing and a two-day evidentiary hearing, the court granted Bavaria’s motion to dismiss the complaint for lack of jurisdiction under the Foreign Sovereign Immunities Act. The court found that aside from a single, preliminary meeting in New York, Bavaria’s acquisition took place in Europe. The court further concluded that the heirs’ claims were based not on Bavaria’s acquisition of the painting in the 1960s, but instead on the alleged circumstances of the prior sale in the 1930s.

Peter Chaffetz is again listed as one of the world’s leading individuals in the area, and is described as “one of finest lawyers on the East Coast”. Charles Scibetta is also highlighted in their write-up as “highly regarded for his ‘stunning’ ligation and arbitration skills across a range of industries including environmental, energy and D&O. He is praised for his ‘client-first attitude’ and ability to form ‘compelling arguments'”.

Chaffetz Lindsey Receives Chambers USA Client Service Award

May 2014 – Chaffetz Lindsey has recevied the Client Service Award for International Arbitration at this year’s Chambers USA Awards. The award is given to the firm that is consistently singled out by clients during Chambers’ research for the quality and range of their client service. As an example, one client stated “I have been continually impressed by [Chaffetz Lindsey’s] dedication, commitment and professionalism – it has been a real pleasure working with them.” The firm is delighted to receive the award and very grateful for the time our clients take to participate in the research process.

The Chambers USA Awards coincide with the release of the 2014 edition of Chambers USA, and Chaffetz Lindsey has been recognized again in the areas of International Arbitration and Insurance / Reinsurance. Steven Reisberg Joins Chaffetz Lindsey

May 2014 – Chaffetz Lindsey has announced that Steven Reisberg, a specialist in commercial litigation, international arbitration and intellectual property, has joined the firm as partner. Prior to joining Chaffetz Lindsey, Steven practiced at Willkie Farr & Gallagher for 28 years.

Steven is an experienced trial lawyer, who has represented clients across a range of industries, including pharmaceuticals, electronics, technology, insurance, and financial services. His cases in federal and state court have included patent litigation, licensing disputes, joint ventures, post M&A and other complex contract disputes. In addition, he has been counsel before domestic and international arbitration tribunals, and also frequently sits as an arbitrator. Steven serves on the Committee on International Commercial Disputes of the Association of the Bar of the City of New York, and is the author of the recent New York Law Journal article “What is Expert Determination? The Secret Alternative to Arbitration.”

Steven’s recruitment follows that of reinsurance specialist Steve Schwartz in February 2014, the promotion of Jennifer Gorskie to partner in January 2014, and several outstanding associate hires this year. Chaffetz Lindsey was established in May 2009 by 5 partners from Clifford Chance, and has grown to 19 lawyers in its first five years.

James Hosking Discusses Investment Trends Between Asia and Latin America

April 2014 – Partner James Hosking spoke at a Hong Kong International Arbitration Centre seminar hosted by Hogan Lovells on “Understanding the Asia-LatAm Trade Relationship” in Miami, which coincided with the ICCA Conference in that city. James was part of an international panel that looked at investment flows in the energy sector, particularly in view of China’s growing need for natural resources. Chaffetz Lindsey Seminar on the Intersection of International Public and Private Law

March 2014 – Chaffetz Lindsey’s latest European Lawyers Forum took the recent crisis in Ukraine and Crimea as a starting point for a discussion about disputes involving the impact of economic sanctions on the enforceability of private commercial contracts. A panel of sanctions and arbitration practitioners, including Maya Lester of Brick Court Chambers in London, Dr. Barbara Maucher of Eren Lawyers in Washington, DC, and Yasmine Lahlou of Chaffetz Lindsey, offered an overview of economic sanctions regimes in the United States and Europe, including how they are promulgated, their form and scope, and how they are enforced, before considering the impact of sanctions on the enforceability of private contracts. Drawing on their experience, the panelists suggested ways in which parties could avoid the impact of sanctions targeting potential commerical partners, the role of international arbitration in resolving disputes that arise in this context, and the availability of interim relief through emergency arbitrations.

The European Lawyers Forum is a Chaffetz Lindsey initiative to provide lawyers trained in Europe or practicing at European-based firms in New York, with a venue to meet and discuss issues affecting U.S./E.U. commerce and dispute resolution. February 2014 – Chaffetz Lindsey is proud to announce that Steve Schwartz has joined us as a lateral partner and that we have promoted Jennifer Gorskie from counsel to partner.

Steve is a widely respected expert in insurance and reinsurance law with broad trial and arbitration experience. He was most recently a partner at Locke Lord, and previously a partner at Clifford Chance, where he worked closely with what is now the Chaffetz Lindsey insurance and reinsurance team. In addition to his active practice as a trial lawyer, Steve is the author of Reinsurance Law: An Analytic Approach, an industry standard treatise. He also publishes and lectures frequently on legal and market issues. Steve is well known to many of our clients and contacts in the insurance and reinsurance industry, and we are extremely happy to be working together again.

Jennifer is a gifted and dynamic lawyer who has played an important role in the firm’s development. Jennifer joined the firm in early 2011 from Cleary Gottlieb Steen & Hamilton, deepening the firm’s capability in international commercial and investment treaty arbitration and U.S. commercial litigation and arbitration. Fluent in Spanish, Jennifer has extensive experience representing sovereigns and companies based in and investing in Latin America. Since joining us, Jennifer has been a key senior lawyer on some of our largest matters, including several international arbitration matters and a number of large reinsurance cases. Jennifer is an up and coming leader in the arbitration legal community. In addition to speaking and writing regularly on arbitration law and practice, Jennifer serves as a board member and Treasurer of the New York International Arbitration Center.
