Eight Chaffetz Lindsey Team Members Ranked Globally by Lexology Arbitration Report

December 2025— The 2026 Lexology Arbitration Report  has once again included Chaffetz Lindsey’s international arbitration team among the top names in arbitration, listing eight team members alongside leading practitioners worldwide.

Anibal Sabater to Speak on New York Arbitration Week Panel

November 2025 – Chaffetz Lindsey’s Aníbal Sabater will participate on an upcoming New York Arbitration Week panel organized by WilmerHale, taking place Tuesday, November 18th.

Aníbal will join the panel “Is New York as a seat and governing law still a top choice for Latin American commercial arbitration?” which will explore the shifting landscape of arbitration choices for Latin American parties. The discussion will address:

  • New York’s historical role as a leading arbitral seat for disputes originating in Latin America
  • The growing competition from other US arbitration seats and seats in Latin America

Aníbal Sabater to Speak on Advanced Oral Advocacy Techniques at CeCAP Seminar in Panama

October 2025 — Chaffetz Lindsey’s Aníbal Sabater will participate as a panelist at the upcoming Seminario de Actualización en Arbitraje Nacional e Internacional, organized by the Centro de Conciliación y Arbitraje de Panamá (CeCAP). The event will take place October 22nd-October 23rd in Panama.

Aníbal will join the panel “Técnicas Avanzadas de Litigación Oral en Arbitraje,” which will explore strategies for enhancing advocacy and case presentation in arbitration proceedings. The discussion will address:

  1. Crafting a memorable and strategic case structure aligned with case theory
  2. Effective direct examination techniques to establish credibility and coherence
  3. Managing expert witnesses, including cross-preparation, “hot tubbing,” and challenging assumptions
  4. Utilizing audiovisual tools and technology such as timelines, maps, and dynamic evidence

Chaffetz Lindsey Secures Resounding Victory for AES in Investment Arbitration Against Argentina

August 2025 – New York, NY – In a landmark decision in favor of The AES Corporation (AES), an international tribunal has awarded the company over US$730 million in an ICSID arbitration against the Republic of Argentina. In its May 30, 2025 award (recently made public), the Tribunal unanimously held the Republic of Argentina liable under the Argentine–U.S. Bilateral Investment Treaty for unlawful and arbitrary interference with AES’s investments in eight power generation facilities. For the Chaffetz Lindsey team, this a significant victory for a longstanding client.

The Tribunal found that Argentina’s measures—including dismantling the electricity sector’s remuneration system, withholding owed receivables, and coercing AES’s subsidiaries to reinvest those receivables in new infrastructure—arbitrarily altered the essential characteristics of the electricity generation framework. These actions constituted violations of Argentina’s treaty obligations. The Tribunal also rejected all of Argentina’s jurisdictional and admissibility objections. As of the date of AES’s petition to confirm the award, Argentina owed US$821,070,619.71, including damages (to date), interest, and arbitration costs, making it the largest award rendered in any of the more than 60 ICSID arbitrations brought against Argentina following the 2001–2002 economic crisis.

“This case is deeply meaningful to our firm,” said James Hosking, Chaffetz Lindsey founding partner and head of the international arbitration practice. “AES entrusted us with this dispute from the moment we launched the firm in 2009. After helping the client navigate a decade-long suspension in which Argentina had promised to implement sector reforms, we were proud to resume the arbitration in 2018 and to deliver this result alongside our good friends at Freshfields and Bruchou.”

The Spanish-English bilingual merits hearing took place in 2023. The Chaffetz Lindsey team was led by partners James Hosking, Aníbal Sabater, and Caline Mouawad, with support from Matilde Flores, May Khoury, Silvia Marroquín, and Agustina Alfaro. Partner Andreas Frischknecht is now leading, as co-counsel with Freshfields, an action to enforce the award in the U.S. District Court for the District of Columbia.

Success in the AES case comes on the heels of a series of other recent investment arbitration wins for the firm, including in the case of APM Terminals Callao S.A. v. Republic of Peru and Clorox Spain S.L v. Bolivarian Republic of Venezuela.

Aníbal Sabater, Gretta Walters, James Hosking Participate in ABA International Arbitration Skills Masterclass

June 2025—Chaffetz Lindsey’s Aníbal Sabater, Gretta Walters, and James Hosking participated in the ABA International Law Section’s 2025 International Arbitration Skills Masterclass, held virtually from Tuesday, June 17th– Wednesday, June 18th.

The program offered junior and mid-level arbitration practitioners a unique opportunity to develop and refine their advocacy skills through a combination of faculty-led plenary discussions and hands-on practice sessions.

Aníbal served as a panelist during the session titled “Cross-Examining and Redirecting Fact Witnesses”. He was joined by internationally recognized colleagues including Henri Alvarez (Alvarez Arbitration), Jan Paulsson (Independent Arbitrator), and Eduardo Zuleta (Arbitration Chambers), with Diana Paraguacuto-Mahéo (Foley Hoag) moderating.

Gretta Walters joined the session “Cross-examining and Redirecting Expert Witnesses” with Preeti Bhagnani (White & Case) and Ari MacKinnon (Cleary Gottlieb). Cesar Pereira (Justen Pereira Oliveira & Talamini) moderated the discussion.

James and Gretta acted as faculty giving feedback to workshop participants during witness examination sessions.

The Masterclass is designed to give participants practical skills critical to the arbitral process, and the fact witness cross-examination panel will feature insights from leading practitioners on how to effectively challenge or rehabilitate testimony in high-stakes international disputes.

Aníbal Sabater to Speak on Arbitrator Ethics at CIArb Learning Lab Series

May 2025– Chaffetz Lindsey’s Aníbal Sabater will speak in the session titled “The Ethical Arbitrator: Conflict Conundrums and Tricky Challenges” as part of the Chartered Institute of Arbitrators’ Learning Lab: Arbitrator Skills Development series. The session will be held online on Thursday, May 15th and is part of a six-part professional development program aimed at enhancing the practical skills of arbitration professionals.

Now in its third edition, the Learning Lab series offers interactive workshops designed to help both experienced arbitrators and those preparing to accept appointments sharpen their case management skills and tackle complex procedural and ethical issues with confidence.
