Caline Mouawad to Speak at 2023 World Arbitration Update

May 2023 – Chaffetz Lindsey’s Caline Mouawad will speak at the upcoming World Arbitration Update on Monday, May 22nd at 11am EST. The World Arbitration Update (WAU) will update the global community on topics of investment and international commercial arbitration and public international law in a decentralized forum.

Caline will join Pedro Soto (Gibson Dunn), Guled Yusuf (Allen & Overy), David Khachvani (Lévy Kaufman-Kohler) and Athina Fouchard Papaefstratiou (Independent Arbitrator) for the panel “Corruption in Investment Projects: The Standard of Proof and the Consequences for Investment Arbitration.” In this discussion, panelists will (i) consider the consequences of corruption for the arbitration depending on whether the corrupt acts took place when the investment was made or when the investment was already operating in the host State; and (ii) address the standard of proof that applies to allegations of corruption in the context of in investment projects, (iii) analyze the lack of clarity and consensus on what the standard of proof is when dealing with allegations of corruption; and (iv) discuss the advantages and disadvantages of a more flexible and case-sensitive standard. Rainbow Willard (Willard Arbitration) will moderate.

Caline Mouawad to Speak on 2023 Paris Arbitration Week Panel

March 2023— Chaffetz Lindsey’s Caline Mouawad will speak at Paris Arbitration Week on Thursday, March 30th. The panel “News from Across the Pond: Recent Vital Developments in U.S. Arbitration Practice” will take place from 8:30am-10am.

Caline will be joined by host speakers Lisa Richman, Romilly Holland and Stefano Mechelli from McDermott Will & Emery and fellow guest speaker Miriam Harwood (Squire Patton Boggs) for a discussion on recent vital developments in U.S. arbitration practice.

Paris Arbitration Week is taking place March 27th-March 31st, 2023. The events are aimed to connect the worldwide community of arbitration practitioners, boosting rich academic debate and promoting Paris as the eternal home of international arbitration.

Caline Mouawad to Attend ERA’s “Meet the Female Arbitrators” Event as Featured Arbitrator

Caline Mouawad Joins Panel at 2023 USC-JAMS Arbitration Symposium in Collaboration with SIAC

March 2023— Chaffetz Lindsey’s Caline Mouawad will speak at the upcoming 7th Annual USC-JAMS Arbitration Symposium in Collaboration with SIAC on Thursday, March 16, 2023. Caline will join Linda A. Klein (Baker Donelson), TJ Auner (Jones Day) and Charline Yim (Gibson Dunn) for the panel titled “Subpoena and Third-Party Evidence – the State of Play” taking place at 11:00am PT/1:00pm ET.

The panel will review the current status of the law on the ability to compel third parties to an arbitration to produce evidence. They will also consider the differences between domestic arbitration and international arbitration, recent 9th Circuit and US Supreme Court cases and other relevant case law.

The Symposium, hosted by the Singapore International Arbitration Center, University of Southern California and JAMS, is the keystone event of the 2nd Annual California International Arbitration Week (CIAW).

Smit-Lowenfeld Prize Awarded to Co-Authors Caline Mouawad Jessica Beess und Chrostin by International Arbitration Club of NY

February 2023— Chaffetz Lindsey’s Caline Mouawad and King & Spalding’s Jessica Beess und Chrostin were recently awarded the twelfth annual Smit-Lowenfeld Prize by the International Arbitration Club of New York for best article in the field of international arbitration. The article, titled “The Illegality Objection in Investor-State Arbitration,” methodically reviews investment awards that involved an illegality objection.  The Smit-Lowenfeld Prize is awarded annually by the International Arbitration Club of New York to recognize the outstanding article published in the previous year on any aspect of international arbitration. The Prize honors the late Hans Smit of Columbia Law School and Andreas F. Lowenfeld of New York University School of Law, both renowned scholars in international litigation and arbitration.

 

Chaffetz Lindsey’s Aníbal Sabater commendend Caline and Jessica for their work. “Caline is a phenomenal lawyer, with deep analytical skills and years of experience in investment cases,” Aníbal stated. “It is no surprise to see her and Jessica recognized for their trailblazing study on the illegality objection, which we wholeheartedly recommend our colleagues read. Three Chaffetz Lindsey Members Among Arbitration Lawyers to Launch New Association Focused on the Arab World

November 2022— Chaffetz Lindsey senior associate May Khoury is among five international arbitration practitioners that are joining forces to launch “ArabArb”, an independent network that aims to unite, promote, and serve the U.S.-based arbitration community with roots, affinity, or interest in the Arab World. Founders of the organization include Randa Adra, partner at Crowell & Moring; Cherine Foty, senior associate at Covington & Burling in Washington, DC; Lillian Khoury, senior associate at Steptoe & Johnson in New York; and Nour Nicolas, associate at Foley Hoag in New York.

Chaffetz Lindsey partners Caline Mouawad and Yasmine Lahlou will sit on the advisory committee of this women-led group, making three out of eleven members represented by the Chaffetz Lindsey team.

Additional advisory committee members include Meriam Al-Rashid, global co-chair of International Arbitration at Eversheds Sutherland; Amal Bouchenaki, partner at Herbert Smith Freehills; Maria Chedid, global co-chair of the International Arbitration Group at Arnold & Porter; and Samaa Haridi, partner at King & Spalding.

IBA Investment Arbitration Subcommittee Finalizes Report on “Arbitrating Small Value Claims In Investment Arbitration”

November 2022— The IBA Investment Arbitration Subcommittee has finalized its report on “Arbitrating Small Value Claims In Investment Arbitration.” The report, authored by Chaffetz Lindsey’s Caline Mouawad, Maxi Scherer (WilmerHale), Noiana Marigo (Freshfields) and Patrick Pearsall (Allen & Overy), examines the mechanisms and strategies available to parties to calibrate time, effort, and financial resources invested to arbitrate small value investment claims in a manner that is commensurate with the sums at stake.

The report examines three aspects of small value claims: (1) empirical data from ICSID, the PCA, and the SCC regarding small value claims registered from 2010 through 2021; (2) special procedures already available to parties in investment agreements and arbitral rules; and (3) various other procedural mechanisms that parties may incorporate into their arbitration and create a bespoke procedure designed to streamline their case and minimize the costs of arbitration.
