Caline Mouawad to Speak at International Court of Arbitration (ICC) Annual Events

November 2023—Chaffetz Lindsey’s Caline Mouawad will participate in the ICC Institute Annual Colloquium on Monday, November 27^th and the ICC Institute of World Business Law Annual Conference on Tuesday, November 28^th.

The 26^th Annual Colloquium of the ICC Institute of World Business Law “Arbitrators in Corporate Disputes: How far can they go?” is a members-only event held at the ICC Global Headquarters in Paris, France. The Colloquium will explore the limits of arbitrators’ powers in resolving corporate disputes and will be introduced by Institute members Olivier Caprasse, Caline Mouawad and José Maria Perez.

The next day, Caline will speak on a panel at the 43rd ICC Institute of World Business Law Annual Conference. The conference titled “Good Faith in International Arbitration: A Versatile Chameleon?” will assess when good faith comes into play at various stages of the international arbitration process and examine the efficacy and limitations of good faith as a legal tool supporting the arbitral process. The conference will take place in Paris, France at Les Salons de l’Hôtel des Arts et Métiers.

Caline will join the Tuesday afternoon panel “Good Faith in Investment Arbitration: What’s different?” and moderate a discussion between Laurie Achtouk-Spivak (Cleary Gottlieb), Sabrina Aïnouz (Squire Patton Boggs), Kabir Duggal (Arnold & Porter) and Samantha Rowe (Debevoise & Plimpton). The session will look at the importance of the good faith principle in international investment law, and how it affects and guides the tribunal’s consideration of the parties’ conduct and arguments at different stages of the proceeding, from making the investment, pre-dispute admissibility requirements, jurisdictional elements, and on the merits of the claims.

October 2023— Chaffetz Lindsey’s Caline Mouawad will join Sylvia Tonova (Pinsent Masons) as session chair of the Thursday morning panel “Highs and Lows in Investment Arbitration” at the 2023 IBA International Bar Association annual conference on November 2^nd.

The panel will look into the main developments of the year in investment arbitration. Speakers include John Adam (Squire Patton Boggs), Professor Luca G Radicati di Brozolo (ArbLit), Levent Sabanogullari (Permanent Court of Arbitration) and Marie Stoyanov (Allen & Overy).

Caline, Co-Chair of the Investment Arbitration Subcommittee, will help conduct one of the committee’s traditional sessions of the year.

October 2023— Chaffetz Lindsey’s Caline Mouawad will speak at the upcoming Seventeenth Annual Investment Treaty Arbitration Conference on Thursday, October 12^th in Washington, DC. The four-panel program will feature leading arbitration practitioners and scholars who will tackle important questions of international investment law and arbitration.

The program format will focus on eight talented ITA “rising superstars” from all over the world, each taking a side in arguing one of four contentious issues. Each author will present and outline their argument papers, after which a panel of experienced and distinguished professionals will debate and discuss the positions taken by the authors and the issue more generally.

Caline will join the first panel of the day for the following discussion: “This coming December, the withdrawal of France, Germany, and Poland from the Energy Charter Treaty will take effect. Leaders in each of these states claimed withdrawal was necessary because ECT obligations were hindering efforts to combat anthropomorphic-driven climate change. Was this stated justification correct as a matter of international investment law?” The following individuals will participate in the panel:

May 2023 – Chaffetz Lindsey’s Caline Mouawad will speak at the upcoming World Arbitration Update on Monday, May 22^nd at 11am EST. The World Arbitration Update (WAU) will update the global community on topics of investment and international commercial arbitration and public international law in a decentralized forum.

Caline will join Pedro Soto (Gibson Dunn), Guled Yusuf (Allen & Overy), David Khachvani (Lévy Kaufman-Kohler) and Athina Fouchard Papaefstratiou (Independent Arbitrator) for the panel “Corruption in Investment Projects: The Standard of Proof and the Consequences for Investment Arbitration.” In this discussion, panelists will (i) consider the consequences of corruption for the arbitration depending on whether the corrupt acts took place when the investment was made or when the investment was already operating in the host State; and (ii) address the standard of proof that applies to allegations of corruption in the context of in investment projects, (iii) analyze the lack of clarity and consensus on what the standard of proof is when dealing with allegations of corruption; and (iv) discuss the advantages and disadvantages of a more flexible and case-sensitive standard. Rainbow Willard (Willard Arbitration) will moderate.

March 2023— Chaffetz Lindsey’s Caline Mouawad will speak at Paris Arbitration Week on Thursday, March 30^th. The panel “News from Across the Pond: Recent Vital Developments in U.S. Arbitration Practice” will take place from 8:30am-10am.

Caline will be joined by host speakers Lisa Richman, Romilly Holland and Stefano Mechelli from McDermott Will & Emery and fellow guest speaker Miriam Harwood (Squire Patton Boggs) for a discussion on recent vital developments in U.S. arbitration practice.

Paris Arbitration Week is taking place March 27^th-March 31^st, 2023. The events are aimed to connect the worldwide community of arbitration practitioners, boosting rich academic debate and promoting Paris as the eternal home of international arbitration.

March 2023— Chaffetz Lindsey’s Caline Mouawad will speak at the upcoming 7th Annual USC-JAMS Arbitration Symposium in Collaboration with SIAC on Thursday, March 16, 2023. Caline will join Linda A. Klein (Baker Donelson), TJ Auner (Jones Day) and Charline Yim (Gibson Dunn) for the panel titled “Subpoena and Third-Party Evidence – the State of Play” taking place at 11:00am PT/1:00pm ET.

The panel will review the current status of the law on the ability to compel third parties to an arbitration to produce evidence. They will also consider the differences between domestic arbitration and international arbitration, recent 9th Circuit and US Supreme Court cases and other relevant case law.

The Symposium, hosted by the Singapore International Arbitration Center, University of Southern California and JAMS, is the keystone event of the 2^nd Annual California International Arbitration Week (CIAW).
