Anibal Sabater to Speak on Damages Panel

March 2015 – Partner Anibal Sabater will participate in a panel discussion hosted by the ICDR Y&I and Compass Lexecon, entitled: “Show The Money: A Frank Conversation About Damages”. The event will take place on March 26, 2015 at Compass Lexecon’s New York office. The panel will feature a frank discussion between counsel, arbitrators and damages experts regarding best practices for putting together the damages portion of a case, and presenting it to the tribunal.

In addition to Anibal, the panelists will be Santiago Dellepiane, Senior Vice President, Compass Lexecon, New York and Laura Hardin, Managing Director, Alvarez & Marsal, Houston; Viren Mascarenhas, Counsel, King & Spalding, New York and Global Advisory Board Member, ICDR Y&I, will moderate the discussion. Samaa Haridi, Partner, Weil, Gotshal & Manges and Executive Board Member, ICDR Y&I, will deliver opening remarks.

April 2014 – Chaffetz Lindsey hosted a seminar organized by the Hong Kong International Arbitration Centre on April 2, 2014 aimed at understanding the role that Chinese state owned enterprises (SOEs) are playing in the global economy, particularly as major foreign investors in countries around the world, including the United States. The event, also sponsored by Jun He, the New York International Arbitration Center, and the Hong Kong Economic & Trade Office, explored the structure and governence of SOEs, unique challenges associated with negotiating and entering contracts with SOEs, and ways to manage risks and avoid disputes associated with investments with SOEs. November 2013 – James Hosking joined a panel in São Paulo this month at the annual conference co-hosted by the International Centre for Dispute Resolution and the American Chamber of Commerce highlighting recent developments in international arbitration concerning Brazil. James’s presentation focused on the interaction between bankruptcy proceedings and arbitration and, specifically, whether a bankruptcy proceeding in the U.S. could have the effect of staying an arbitration in Brazil. Chaffetz Lindsey continues to be involved in several international arbitrations on behalf of Brazilian clients or clients with investments in Brazil. October 2012 – Chaffetz Lindsey Partner James Hosking recently participated in two panels that looked at the protection available for Chinese outbound investments around the world. The growth in Chinese outbound investment looks set to continue, as China seeks to address its energy needs and other growth priorities. As Chinese companies invest in new and/or high risk regions, the potential for disputes grows, and the need to understand the choices available to protect and resolve disputes becomes more acute.

On October 18, James was part of a panel at the second annual GAR Live Asia conference in Hong Kong that considered the steps Chinese investors should take to avoid disputes involving their investments, and the options available to them when disputes arise, including bilateral investment treaties. GAR Live Asia was part of Hong Kong’s International Arbitration Week, which included a series of conferences and other events.

On October 19, again in Hong Kong, James participated in a client seminar organized by Asia based King & Wood Mallesons. This panel discussed in detail the protection afforded by investment treaties and specific strategies to protect Chinese investment in the U.S..

October 2012 – Chaffetz Lindsey Counsel, Yasmine Lahlou, recently joined a panel to discuss the ins and outs of international arbitration at the American Bar Association Section of International Law 2012 Fall Meeting. The panelists engaged in a practical discussion about the different stages of an international arbitration, from the preparation of the request for arbitrration to the complexities associated with obtaining and presenting evidence, cross-examination, and enforcement of awards.

Yasmine has represented clients in a broad range of disputes before a variety of arbitration venues under the ICC, ICDR, NAI, FINRA and UNCITRAL Rules, and has sat as an arbitrator for the ICC and SCC. Most recently, Yasmine was part of the team that represented a Brazilian private equity firm in a loan-related dispute against one of the world’s largest hedge funds.

November 2011– Chaffetz Lindsey lawyers David Lindsey, James Hosking and Jennifer Gorskie recently attended various conferences and meetings in Brazil.

James Hosking was a participant in a roundtable organized by Latin Lawyer to discuss the state of international arbitration in Brazil in the 15 years since it passed its international arbitration law.  The November 28 roundtable featured top Brazilian arbitration lawyers and arbitrators as well as foreign lawyers from firms engaged in arbitrations involving Brazil.

A theme of the discussion was how quickly a sophisticated Brazilian bar has developed.  The roundtable was written up in Latin Lawyer and can be read here (subscription required).

On November 29, James was a panelist, and Chaffetz Lindsey a sponsor, at the annual arbitration conference organized by the International Centre for Dispute Resolution (ICDR) and the Arbitration Center of the American Chamber of Commerce of São Paulo (AMCHAM).  The conference was titled “International Business Transactions and Conflict Management: The U.S. and Brazilian Perspectives”.  James discussed issues arising from electronic disclosure of documents in arbitrations and provided tips on how to handle review and production of electronically stored information.  The conference program is available here.

Chaffetz Lindsey lawyers have been involved in Brazilian arbitration matters for more than 15 years.  The firm regularly co-counsels with Brazilian forms in arbitrations and also represents Brazilian clients in U.S. litigations.

October 2011 – James Hosking was a panelist at the Practicing Law Institute’s 2011 “Commercial Arbitration” seminar held on October 12. The theme of the seminar was strategies for increased efficiency and cost-effectivenes in commercial arbitration. James’ panel addressed recent developments in international arbitration, including the revised ICC Arbitration Rules that will come into force in 2012. James focused on emergency measures of protection available before an international arbitration tribunal is constituted. His review of the procedural mechanisms employed by various arbitral institutions—including the ICC, ICDR, ICSID, LCIA, SCC, SIAC, and NAI—highlighted the wave of revisions in institutional rules to accommodate requests for pre-arbitral relief. March 2011 – Chaffetz Lindsey is continuing its support of the annual Willem C. Vis International Commercial Arbitration Moot. The moot, held each year in Vienna, brings together students from around the world to compete in rounds of mock arbitral hearings.  This year’s moot – the 18th  – will be attended by students from 262 universities and 66 countries.

In recent weeks, Chaffetz Lindsey’s James Hosking and Yasmine Lahlou have acted as arbitrators in several moot preparation events in New York and on March 26 the firm hosted a practice session. In addition, James was a keynote speaker at the pre-moot event held at the American Arbitration Association’s International Centre for Dispute Resolution on March 11.  James is also a co-coach of the Harvard Law School Vis team.

June 17, 2010 – Chaffetz Lindsey partner James Hosking was one of the presenters in the 21^st Annual Institute for Transnational Arbitration Workshop in Dallas.  This year’s workshop featured an innovative format of a mock arbitration that will be played out over three annual events, each focusing on a different aspect of arbitration strategy and practice.  The workshop also featured a controversial interactive session on “Corporate Perspectives on the Arbitral Process”.  The event was attended by several hundred lawyers, academics, corporate counsel and other members of the arbitral community.  The workshop is also video-taped and used for educational purposes in teaching arbitration practice strategy.

Chaffetz Lindsey also was a sponsor of the ITA Young Practitioners Roundtable that took place in Dallas on June 16, 2009.  Chaffetz Lindsey partners David Lindsey and James Hosking are members of the ITA Advisory Board.

October 2009 – On November 12, 2009, Chaffetz Lindsey partner Peter Chaffetz will speak during the first General Session of ARIAS US’s 2009 Fall Conference. Peter and his co-panelists, Peter Gentile (arbitrator), Kathryn Ellsworth (Grais & Ellsworth), and David Thirkill (The Thirkill Group, Inc.), will speak on issues that can arise in arbitration in light of the current economic climate. The panel will cover questions concerning extra-contractual security, whether a party’s financial condition should be considered in setting the scope of discovery or hearing, and other topics relevant in today’s economy.
