Aníbal Sabater Speaks at 1st ICC International Arbitration Forum in Dominican Republic

April 2015 – The ICC International Court of Arbitration and ICC Dominican Republic recently organized the “1st ICC International Arbitration Forum in Santo Domingo: The Arbitral Award – An integral view” which was held in Santo Domingo (Dominican Republic) on April 23-24, 2015.  Chaffetz Lindsey partner Aníbal Sabater sat on a panel called “Award Motivation Analysis Test” alongside Adriana Bragheta (L.O. Baptista Advogados Associados SC, Sao Paolo , Brazil), Álvaro Castellanos (Consortium Centro America Abogados, Member of the International Court of Arbitration of the ICC by Guatemala) and Galina Zukova (White & Case LLP, Paris, France).  The panel moderator was Lorena Perez McGill (until recently, from the legal department of the OAS, in Washington, USA).

March 2015 – Chaffetz Lindsey partner Aníbal Sabater recently spoke at a seminar titled “ICDR Awards and Commentaries: Just How Different Is International Arbitration Than Domestic Arbitration?” which was sponsored by The American Arbitration Association.

In 1996, the International Centre for Dispute Resolution (ICDR) – the international arm of the American Arbitration Association (AAA) – was given responsibility for the AAA’s international services and the AAA’s international rules were revised and rebranded as the ICDR. In 2003, the ICDR Rules were amended to provide for publication of redacted arbitration awards. It is now widely accepted that publication of arbitration awards, even in redacted form, contributes importantly to the development and standardization of international arbitration law, particularly regarding procedural matters.

During this webinar that took place on March 18th, Aníbal, Grant Hanessian (of Baker & McKenzie LLP), and Luis Martinez (Vice President of the International Centre for Dispute Resolution®), all distinguished international arbitration experts, discussed:

 

• published ICDR awards and the lessons they provide for counsel and parties;
• differences between international arbitration and domestic arbitration;
• recent ICDR Rules changes; and
• the perspectives of international arbitrators on the conduct of an international arbitration.

May 2015 – Chaffetz Lindsey partner Aníbal Sabater is a panelist at the upcoming IACAC Annual International Arbitration Conference taking place in Panama City, Panama on May 17, 2015.  This two-day conference focuses on the 40th Anniversary of the Panama Convention. Its development and application as well as additional related issues will be explored by leading international experts, including ICDR VP Luis Martinez, Rafael Bernal Gutierrez (Presidente de la Comisión Interamericana de Arbitraje Comercial (CIAC)), and Adriana Polania (Directora General de la Comisión Interamericana de Arbitraje Comercial – CIAC- Colombia).

Aníbal and Mauricio Gomm Santos (Gomm & Smith, Brazil) will lead a session on Tuesday, May 19th at 9am titled “Implementation of the Convention of Panama: Mail Case Law on the Convention of Panama.”

March 2015 – Chaffetz Lindsey partner Yasmine Lahlou helped to lead a workshop on March 5, 2015, organized by Young ICCA, a world-wide arbitration knowledge and skills network for young practitioners.

The topic of the workshop was “Working with Clients in International Arbitration – a Young Practitioner’s ‘How To’ Guide.”  It focused on practical tips for working effectively with clients of different jurisdictions and backgrounds and developing strong client relationships.

Other workshop leaders, which included a faculty of senior leaders and highly experienced younger arbitration practitioners, were James Carter (WilmerHale), Elliot Polebaum (Fried Frank),  Aloysius Llamzon (King & Spalding), Monique Sasson (Morgan Stanley), Emma Lindsay (Bryan Cave) and Rocio Digón (ICC / SICANA).

February 2015 – Aníbal Sabater, Partner at Chaffetz Lindsey LLP, was a panelist at the 40th Anniversary of the Inter-American Convention on International Commercial Arbitration (The Panama Convention) sponsored by American University’s Washington College of Law.  The panel discussed the treaty, its application, its comparison to the New York convention, and some of its unique provisions including its article 3 that references the Inter-American Commercial Arbitration Commission.

April 2015 – Aníbal Sabater, Partner at Chaffetz Lindsey LLP and NYIAC Program Committee Chair, recently gave the closing remarks at The New York International Arbitration Center’s (NYIAC) Grand Central Forum.  Held on April 16th, this event brought together business, legal and diplomatic leaders from the New York City region to discuss key issues in the resolution of high-value international disputes. The keynote speaker was Cherie Blair, CBE, QC (Founder and Chair of Omnia Strategy), a specialist in international dispute resolution and an expert on the intersection of business and human rights issues. Mrs. Blair addressed the topic “Managing Risk in Cross-Border Disputes” with reference to arbitration disputes and strategies concerning both commercial and sovereign state parties.

April 2015 – James Hosking, Partner at Chaffetz Lindsey LLP, was recently a panelist at the Harvard International Arbitration Conference (HIAC), organized by the Harvard International Arbitration Law Students Association (HIALSA).  The event gathers students, practitioners and scholars interested in international arbitration to discuss current topics.  This year’s focus was “Intersections between Commercial and Investment Arbitration,” and the panel on which James spoke was titled “Alternative Means of Enforcement: Enforcing Commercial Arbitration Awards through Investment Arbitration.”  James addressed the remedies available in investment arbitration to compensate claimants for breaches of international law involving interference with international arbitration agreements or awards.

March 2015 – Partner Anibal Sabater will participate in a panel discussion hosted by the ICDR Y&I and Compass Lexecon, entitled: “Show The Money: A Frank Conversation About Damages”. The event will take place on March 26, 2015 at Compass Lexecon’s New York office. The panel will feature a frank discussion between counsel, arbitrators and damages experts regarding best practices for putting together the damages portion of a case, and presenting it to the tribunal.

April 2014 – Chaffetz Lindsey hosted a seminar organized by the Hong Kong International Arbitration Centre on April 2, 2014 aimed at understanding the role that Chinese state owned enterprises (SOEs) are playing in the global economy, particularly as major foreign investors in countries around the world, including the United States. The event, also sponsored by Jun He, the New York International Arbitration Center, and the Hong Kong Economic & Trade Office, explored the structure and governence of SOEs, unique challenges associated with negotiating and entering contracts with SOEs, and ways to manage risks and avoid disputes associated with investments with SOEs. November 2013 – James Hosking joined a panel in São Paulo this month at the annual conference co-hosted by the International Centre for Dispute Resolution and the American Chamber of Commerce highlighting recent developments in international arbitration concerning Brazil. James’s presentation focused on the interaction between bankruptcy proceedings and arbitration and, specifically, whether a bankruptcy proceeding in the U.S. could have the effect of staying an arbitration in Brazil. Chaffetz Lindsey continues to be involved in several international arbitrations on behalf of Brazilian clients or clients with investments in Brazil.
