February 2016 – Aníbal Sabater will be guest lecturing at an International Energy Law course at Washington College of Law (American University) in Washington, D.C. on February 23, 2016.
February 2016 – Chaffetz Lindsey partner Steven Reisberg was one of the featured speakers at a symposium sponsored by the Fordham International Law Journal on Recent Developments in International Arbitration. Held at Fordham Law School on February 19th, the symposium is an event where international arbitration scholars and practitioners from Santiago, Paris, and New York City gather to reflect on important questions concerning the role of party autonomy and other recent developments in the field of international arbitration.
This year’s program also honored Professor Arthur Rovine for his contributions to the field of international arbitration and the law school.
February 2016 – The 2016 AAA/ICDR Arbitrator Conference is being held at the Roosevelt Hotel in New Orleans this week. Chaffetz Lindsey partners James Hosking and Aníbal Sabater will both be speaking at two different sessions on Friday, February 19th.
James Hosking, along with Luis M. Martinez (Vice President, ICDR), will present “New Challenges for International Arbitrators – An Introduction to the 2014 ICDR International Rules.” It has now been one and a half years since the ICDR Rules were updated and amended. As one of the members of the revision committee, James will talk about the genesis of the amendments, how they have been applied in practice, and what may be in store in the future.
Aníbal Sabater will speak at Friday’s Lunch Presentation alongside Theo Cheng (Partner at Fox Horan & Camerini LLP) and Harold Coleman (Executive Director & Mediator – Mediation.org, a Division of the American Arbitration Association and Principal – Harold Coleman, Jr. Ltd.). Their presentation, titled “Emerging Importance of Cross-Cultural Competency in ADR,” will be moderated by Sasha Carbone (Associate General Counsel for the American Arbitration Association).
February 2016 – On February 15, Yasmine Lahlou presented a lecture to students of Professor Andrea Bjorklund’s class on international arbitration at McGill University. Yasmine’s presentation, entitled “International Arbitration in a Flat World: a Beauty Contest in a Global Marketplace,” focused on strategic considerations when selecting the seat and the rules applicable to the arbitration.
February 2016 – Signed on February 4, 2016 in Auckland, New Zealand, the Trans-Pacific Partnership (once in force) will cover a market of 800 million people representing 40% of global GDP. In the face of extreme opposition to investment protections in Europe and elsewhere, the TPP represents a reaffirmation of a multilateral approach to establishing minimum investment protection standards and of access by investors to arbitration to enforce those rights.
In this NYIAC breakfast seminar*, taking place on February 24, 2016 from 8:30am-10:00am at NYIAC, James Hosking of Chaffetz Lindsey LLP provides an overview of the key provisions of the TTP, how it differs from existing treaties, and what it suggests about the future of investor-state dispute settlement.

February 2016 – The annual Georgetown International Arbitration Month (GIAM) is taking place in Washington, D.C. this February, and this year’s theme is “Multistakeholder Views of International Arbitration.”
GIAM events take place in Washington, D.C. throughout the month of February and join practitioners, scholars, and students from around the world for a series of panels on emerging issues and trends facing the international arbitration community. GIAM 2016 features a series of panels on cutting-edge issues in commercial and investment arbitration, and other aspects of dispute resolution and trade. Owing to the ever-evolving nature of our field, this year’s GIAM will incorporate new perspectives on issues including representatives from the private sector and various governments.
Chaffetz Lindsey’s Gretta Walters will be speaking on Tuesday, February 9th alongside Rocio Digon, Alex Lo, and Danielle Morris. The panel, taking place from 6:30 – 8:30 PM at WilmerHale’s DC office, will discuss “What Does an Arbitration Cost?”

January 2016 – The International Centre of Dispute Resolution, the international division of the American Arbitration Association, has been at the forefront of international alternative dispute resolution (ADR). This year’s International Arbitration Conference in Miami celebrates and analyzes the ICDR’s accomplishments, while looking ahead to the future of the international arbitration field.
Chaffetz Lindsey partner Aníbal Martín Sabater is a faculty member for a panel on Thursday, January 28th at 4pm titled “The Lagging Acceptance of International Mediation.” This session will discuss the interesting and growing practice of mediation in recent years and why it still lags behind arbitration. The panel will also examine how the international business community benefit more from this excellent tool.
Thomas J. Stipanowich, of the Straus Institute for Dispute Resolution, will be the Session Keynote Speaker, followed by a discussion to be led by additional faculty members Mercedes Tarrazon (Dispute Management; Barcelona) and Eduardo Zuleta (Gómez-Pinzón Zuleta; Bogotá). Edna Sussman of Sussman ADR will serve as the moderator.

January 2016 – Three premier institutions are joining forces to present a highly regarded energy arbitration program this week in Houston, Texas. The Institute for Transnational Arbitration (ITA), the Institute for Energy Law (IEL), and the International Court of Arbitration of the International Chamber of Commerce (ICC) have developed a program that will address the essential current influences on arbitration in the energy sector today. Two Chaffetz Lindsey partners have been invited to speak at this event, which will take place January 14-15, 2016, at the Omni Houston Hotel.
On Thursday, January 14th at 4:00 pm, Jennifer Permesly will speak on cybersecurity and data privacy alongside Jonathan Fairtlough (Managing Director, Cyber Security and Investigations, Kroll, Los Angeles) and Melinda L. McLellan (BakerHostetler, New York) in a panel moderated by Robert Carlton (Haynes and Boone, LLP, Houston). This session will analyze the impact of recent breaches of cybersecurity and data privacy on the arbitration community and discuss how such breaches can be avoided in the future.
On January 15th at 2:30 pm, Aníbal Sabater will speak at a panel session titled “Emergency Arbitrator Proceedings In Oil & Gas Disputes” alongside Rocío Digón (Managing Director and Counsel, ICC International Court of Arbitration, SICANA, Inc., New York) and Mark W. Friedman (Debevoise & Plimpton LLP, New York). Moderated by Kevin O’Gorman, (Norton Rose Fulbright US LLP, Houston), this panel will discuss the utility emergency arbitrators can have in oil and gas cases, as well as what standards and procedures govern the granting of emergency relief. Also up for discussion by this panel is whether courts can enforce emergency arbitrator rulings.

November 2015 – Expansión and Acciona joined forces to assemble a prestigious group of national and international experts, which took place at the Hotel InterContinental in Madrid on November 24, 2015. The experts shared their experiences on using alternative dispute resolution mechanisms in the infrastructure and energy sectors, as these mechanisms are increasingly popular in global business practice for their efficiency and practicality. The event aimed to delve into the different existing ADRs, their application in the energy and infrastructure sectors, and key practices for successful implementation.
Chaffetz Lindsey partner Aníbal Sabater presented as an expert at this event. His session addressed commercial arbitration in construction and energy in the United States.

November 2015 –The International Centre for Dispute Resolution® (ICDR®), the international division of the American Arbitration Association® (AAA®), the Arbitration and Mediation Centre of the Brazil-Canada Chamber of Commerce (CAM-CCBC), and the Arbitration Centre of the American Chamber of Commerce (AMCHAM), São Paulo, are jointly hosting the 9th International Arbitration and Mediation Conference on November 18, 2015, in Rio de Janeiro, Brazil. This year’s conference, which brings together in-house counsel and attorneys, experts, arbitrators, and mediators, will focus on the various types of industries–and the possible disputes that may arise–related to the Olympic Games to be held in Rio de Janeiro in 2016.
The program will focus not only on sports arbitration: additional sessions will cover international ADR best practices as they relate to licensing, construction, and infrastructure projects as well.
Chaffetz Lindsey partner James Hosking is a faculty member for a session titled “International Construction and Infrastructure Projects: The Latest Conflict-Management Options.” The panel will focus on innovative tools to use in international arbitration and mediation of disputes stemming from construction and infrastructure projects. Several members of the Chaffetz Lindsey team are involved in such disputes involving Brazil and many other jurisdictions.
James will be joined on the panel by Oliver J. Armas (Hogan Lovells LLP, New York); Tony Dymond (Debevoise & Plimpton LLP, London); Patricia D. November 2015 – The NYSBA teamed up with the AAA to hold the most realistic arbitration experience for New York State Law student-participants.
The NYSBA/AAA Moot Arbitration Competition was held on November 13th and 14th at AAA/NYIAC’s office on 42nd Street in Manhattan. All of the participants arbitrated before the best arbitrators in the state of New York and received feedback from leading practitioners in the field. Additional networking and training sessions were offered to the the participants.
Chaffetz Lindsey partner Steven Reisberg participated on a panel discussing the preliminary conference that occurs at the first hearing with the arbitrators to set the schedule for the proceeding.

November 2015 – The 2015 ARIAS Fall Conference is taking place in New York City this week. At this year’s conference, Chaffetz Lindsey partners Peter Chaffetz and Steve Schwartz are each speaking on panels.
Steve’s panel, “Improving the Arbitral Process through Team Engagement: How Counsel, Arbitrators and Company Representatives Can Make a Difference.” This session will focus on ways in which outside counsel, inside counsel and party arbitrators can work together as a team to make the reinsurance arbitration process, which is frequently criticized as too slow, too expensive and too unpredictable, work better for everyone. Other presenters include Robert E. Sweeney, Jr., CNA and Sylvia Kaminsky, Arbitrator / Reinsurance Consultant.
Peter is speaking with Jan Woloniecki, of ASW Law Limited, on “Contract Avoidance under U.S., UK and Bermuda Law.” They will lead a discussion on rescission and avoidance of reinsurance contracts, comparing New York, Bermudian and New English Law.
