David Lindsey to Speak on International Arbitration at NY City Bar Event

September 2016 – David Lindsey, partner and co-founder of Chaffetz Lindsey, will speak tonight at the New York City Bar’s “Hot Practice Areas: Privacy/Cybersecurity, Investment Funds, International Arbitration, Securities Litigation” event taking place at 42 West 44th Street in New York, NY.

David will discuss the legal specialty of International Arbitration; the path that led him to this specialty; the types of matters to expect in this area; determining whether this area might be of interest; the skills he has used/developed; the advantages/disadvantages of specializing; long-term possibilities, including firm, in-house, and public sector options; and how to enter or transition into this area.

Aníbal Sabater to Speak at Latin Lawyer 7th Annual Private Equity Conference

September 2016 – Aníbal Sabater, Chaffetz Lindsey partner and  international arbitration specialist, will be a speaker at the Latin Lawyer Private Equity Conference taking place in New York on Monday, September 26th.  His panel, titled “Beauty and the Beast: From populism to orthodoxy,” will discuss what has been the experience for investors in various Latin American jurisdictions with expropriations or rule changes.  More specifically:

  • Argentina: what has been the balance of Argentina’s populist adventure? The Macri Era – a feasible, new beginning?
  • Venezuela: experience in nationalization and investment treaty arbitration
  • Functioning of investment treaties to hedge sovereign risk
  • SEC listing as hedge of sovereign risk?

Yasmine Lahlou to Speak at Roma Tre University’s Certificate on International Commercial and Investment Arbitration

September 2016 – Yasmine Lahlou will serve as a Faculty Member at the upcoming Certificate on International Commercial and Investment Arbitration, a program organized by the University of Roma III, being held in Rome from September 26th through September 30th.

Yasmine will be speaking on “Complex privity: Extension of arbitration obligations in multiparty transactions.”

This is the third edition of the Certificate Program, which is led by prominent academics, in-house counsel and practitioners aimed at providing theoretical and practical insights, including interactive workshops, about investment and commercial arbitration. The program is hosted by the University, the International Chamber of Commerce, the Associazione Italiana Per L’Arbitrato, and the Camera Arbitrale Milano.

HOSKING & REISBERG FACULTY FOR NYSBA 2016 COMMERCIAL ARBITRATION TRAINING PROGRAM

June 2016 – Chaffetz Lindsey partners James Hosking and Steven Reisberg served as Program Faculty for the 2016 Commercial Arbitration Training for Arbitrators and Counsel hosted by the New York State Bar Association Dispute Resolution Section and Benjamin N. Cardozo School of Law.  This comprehensive training program was conducted by seasoned arbitrators, counsel, arbitration administrators, and academics, focusing on Best Practices, from the perspectives of arbitrators and counsel.

James instructed alongside other experts in two different sessions: “Advocates’ Best Practices in Selecting Arbitrators and Representing Clients in Arbitration” and “Award Writing.”  Steven Reisberg spoke on the topic of “Pre-Preliminary Hearing Issues – Ethical and Other Issues.”

James has 20 years of international dispute resolution experience. He is a recognized expert in international arbitration, having handled disputes under the rules of all the leading institutions, including ICC, AAA/ICDR, SIAC, LCIA, WIPO, CRCICA and ICSID, as well as the UNCITRAL Rules. His recent cases have involved international commercial contracts, corporate acquisitions, construction/engineering, licensing/distribution, energy/power projects, JV/shareholder disputes, mining, and investment treaty claims. James also sits as an arbitrator, having acted as chairman, sole arbitrator, co-arbitrator and emergency arbitrator. In addition, he represents clients in US commercial litigation in state and federal courts.

Steven has been helping clients for more than 30 years to resolve complicated business disputes.  Steven is a highly skilled trial lawyer, representing clients as both plaintiffs and defendants in complex commercial litigation, arbitrations, and intellectual property disputes.  He has represented companies and individuals in cases before U.S. federal district, appellate and bankruptcy courts, state courts, national and international arbitration tribunals, and administrative agencies, including the ITC and the SEC. Steven serves as an arbitrator in both international and domestic cases.

Aníbal Sabater’s NYIAC Grand Central Forum Interview with Gary Born Highlighted in GAR

July 2016 – Aníbal Sabater recently moderated the New York Arbitration Center’s Grand Central Forum and interviewed Gary Born, who is president of SIAC and head of international arbitration at Wilmer Cutler Pickering Hale and Dorr. Claudia Salomon of Latham & Watkins also participated in the discussion. Global Arbitration Review has summarized that interview in an article called “Game of Tribunals,” a clever play on Born’s references to Game of Thrones.

Born addressed a range of topics from the continuing importance of the seat of arbitration to the Lord Chief Justice of England and Wales’s recent comments proposing more judicial review of cases and the criticisms that face investor-state dispute settlement. He contends that international arbitration has enjoyed “a long golden summer when everything went right” but “winter is coming,” and as such the community needs to defend it more vigorously.

July 2016 – Chaffetz Lindsey partner Aníbal Sabater will be speaking in a roundtable discussion being hosted by the ABA’s Alternative Dispute Resolution Committee and the Arbitration Subcommittee on Monday, July 18, 2016 from 12:00 pm – 1:00 pm Eastern.  Aníbal will be joined by other experienced arbitration practitioners Lawrence S. Schaner (Jenner & Block LLP) and Charlene C. Steven Schwartz to Speak on Allocating a Settlement and Mediation Tips and Strategies at ACI Conference

June 2016 – Chaffetz Lindsey partner Steven Schwartz is speaking at American Conference Institute’s 3rd National Insurance Allocation seminar on Friday, June 24th at The Carlton Hotel in New York City.  Steve will participate on a panel on “Allocating a Settlement and Mediation Tips and Strategies.” The panel will address allocation issues that come up in connection with mediation of complex insurance claims.  Among other things, the panel will address the impact of reinsurance on allocation and on mediation strategies.

Steve has devoted much of his practice to reinsurance litigation and arbitration since the early 1990s. He has represented major insurance and reinsurance companies in disputes involving property/casualty reinsurance, life/health reinsurance, insurance insolvency, alternative risk transfer and finite risk reinsurance. Steve has also represented clients in litigation relating to mergers and acquisitions of reinsurance companies, and in other disputes arising out of the use of reinsurance in corporate transactions.  He has acted as first chair in numerous arbitration hearings and in trials in federal and state court.

Gretta Walters Speaks at Co-Chairs’ Circle Second Global Conference in Helsinki

May 2016 – Gretta Walters will be moderating a panel at the Co-Chairs’ Circle Second Global Conference in Helsinki on May 27th.  The panel will discuss to what extent parties and counsel involved in an arbitration can have an obligation to disclose hidden information relevant to the outcome.

This year’s conference, Controversy in International Arbitration, is hosted by Young Arbitration Club Finland and jointly organized by 19 young arbitration practitioners’ organizations.

 

 

Aníbal Sabater to Lead Judith S. Kaye Arbitration Lecture at NYIAC’s Grand Central Forum

May 2016 – The New York International Arbitration Center (NYIAC) will be hosting its Second Annual Grand Central Forum on May 18th, 2016 from 5pm to 9pm.  The NYIAC Board of Directors has established the Judith S. Kaye Arbitration Lecture, to be given annually in conjunction with the Grand Central Forum, in memory of the Hon. Judith S. Kaye, a visionary leader in New York’s legal community who passed away in January.  In addition to her 25 years of service on the New York Court of Appeals, Judge Kaye was the Founding Chair of NYIAC, to which she brought her characteristic dedication and verve.  This year, the Judith S. Kaye Arbitration Lecture will feature Gary Born, Chair of the International Arbitration Practice Group at Wilmer Hale, in the format of a conversation with Chaffetz Lindsey partner Aníbal Sabater (NYIAC’s Program Committee Chair) and Claudia Salomon (Latham & Watkins LLP).  The conversation will cover topics such as: When (if ever) should annulled awards be enforced?; Is “manifest disregard of the law” a viable ground for annulment? Should calls from the English judiciary for enhanced review of arbitration be heeded?  Are criticisms of investor-state arbitration well founded?

The Lecture will be preceded by a panel of experts from around the world who will debate the question, “Is There a U.S. Culture of International Arbitration”? The panel, moderated by Caline Mouawad (King & Spalding LLP), will include Jalal El Ahdab (Ginestie Magellan Paley-Vincent), Claudia Frutos-Peterson (Curtis, Mallet-Prevost, Colt & Mosle LLP), Gregory Litt (Skadden, Arps, Slate, Meagher & Flom LLP), and Eloïse Obadia (Derains & Gharavi).

Diego Guevara Speaks to Foreign Lawyers at Georgetown Law

April 2016 – On March 30, 2016, Chaffetz Lindsey associate Diego Guevara spoke on a panel at Georgetown Law at a discussion entitled  “Promoting International and Comparative Law.” The event was hosted by the Foreign Lawyers at Georgetown (FLAG), an organization that supports non-US students who are pursuing advanced degrees at Georgetown. The purpose of the discussion was to give the audience personal perspectives on how issues of international and comparative law confront practitioners whose practice extends beyond the borders of the US. Each of the panelists covered a different region of the world. Diego covered Latin America, drawing on his experience in the region, including his time spent as a foreign legal consultant in Brazil. Co-panelist Jennifer Lim, of Debevoise & Plimpton, covered East Asia and the UK, and co-panelist Nilesh Sinha, formerly of Jindal Global Law School, covered South Asia. The panel was moderated by Prof. David Koplow.

James Hosking and Gretta Walters to Speak on “The ICDR’s International Arbitration Rules: Assessing the Impact of the 2014 Amendments”

April 2016 – James Hosking and Gretta Walters will be speaking on a webinar hosted by the American Arbitration Association on Monday, April 18, 2016, from 12pm to 1pm. The webinar is titled “The ICDR’s International Arbitration Rules: Assessing the Impact of the 2014 Amendments.”

DESCRIPTION
The International Centre for Dispute Resolution was launched in 1996 as the international arm of the American Arbitration Association and provides administrative services—including arbitration and mediation—for international disputes. For arbitrations in the international context, the ICDR applies any one of several sets of rules and procedures, foremost of which are the ICDR Rules, part of the ICDR’s International Dispute Resolution Procedures.

Effective June 1, 2014, the ICDR amended its International Rules. Nearly two years later, arbitrators, practitioners and corporate users should be aware of the ongoing implications of the changes.

This 60-minute webinar will examine the amendments to the Rules, why they were made, and how they have been applied in practice since their implementation.

Some of the areas that will be covered include the following:

  • Key changes to the Rules (expedited procedures, mediation, joinder and consolidation, enhanced arbitrator powers, exchanges of information);
  • Practical implications of the changes;
  • How the changes compare to recent amendments in other arbitration rules;
  • Looking ahead: Trends in international arbitration.

Yasmine Lahlou Presents at 2016 GAR Live Conference in Brazil

March 2016 – Global Arbitration Review presented their annual GAR Live one-day conference at The Hotel Unique, São Paulo on March 17, 2016, in association with CAM/CCBC.  Sessions at the conference included “What are the challenges and particularities of arbitrations involving states and state-owned entities?;”  “Private vs public disputes – a view from inside;”  “The boom in anti-corruption investigations and the effect on arbitration;”  and “So-called guerrilla tactics and their use in international arbitration.”

Chaffetz Lindsey partner Yasmine Lahlou spoke on a panel titled “The boom in anti-corruption investigations and the effect on arbitration,” which addressed how the significant increase in anti-corruption legislation and investigations around the world, including Brazil, is taking its toll on the world of arbitration. The panel discussed how an arbitrator should act or react in cases in which there are corruption allegations and which of the many global laws, many with extra-territorial reach, apply. Other panelists included Marcelo Muriel of Muriel Medici Franco, Klaus Reichert SC of Brick Court Chambers, Luiz Olavo Baptista of Atelier Jurídico.  The panel was moderated by Adriana Braghetta of L.O. Baptista, Schmidt, Valois, Miranda, Ferreira & Agel.
