Chaffetz Lindsey Announces Inaugural Young ICCA- Chaffetz Lindsey Scholarship for the Certificate in International Commercial and Investment Arbitration

August 2024—Chaffetz Lindsey is proud to announce the inauguration of the Young ICCA-Chaffetz Lindsey scholarship, to allow a Young ICCA member to participate in the Certificate in International Commercial and Investment Arbitration, which is organized by Università degli studi Roma Tre and Associazione Italiana per l’Arbitrato – AIA and held under the auspices of the Roma Tre – UNIDROIT Centre for Transnational Commercial Law and International Arbitration. The €1500 scholarship will cover the full registration fee for the Certificate and a portion of travel expenses.

The scholarship brings together two long-standing Chaffetz Lindsey initiatives. Partners James Hosking and Yasmine Lahlou have both been on the Certificate faculty since its inception; while James Hosking has been a Young ICCA mentor for many years and several other firm members have been involved in the group’s mentoring program.

Head of international arbitration and ICCA Governing Board member, James Hosking says “I’m very pleased that we can bring together two of my favorite programs and, consistent with ICCA’s objective of promoting diversity and inclusion in international arbitration conferences, offer access to the Certificate to participants who would not otherwise be able to attend.”

The next edition of this annual in-person program will take place from September 23rd– 27th, 2024 at Roma Tre University in Rome. Led by academics, in-house counsel and practitioners, the Certificate spans five days of engaging sessions and practical roundtables on international commercial and investment arbitration. The program also includes the Roma Tre University – UNIDROIT Annual International Arbitration Lecture, delivered this year by Mohamed Abdel Wahab, Professor of International Arbitration at Cairo University and Founding Partner at Zulficar & Partners Law Firm.

To Apply for the Scholarship

To apply, Young ICCA members must submit (in the form of a single PDF):

  • a letter of motivation expressing their interest in participating in the Certificate, including a description of their arbitration experience (maximum 400 words); and
  • a resume or CV.

In granting the Scholarship, priority will be given to candidates from historically disadvantaged or underrepresented (minority) groups, including in relation to age, color, disability, ethnicity, gender, indigenous origin, race, religion, sexual orientation or socioeconomic status.

The applications should be sent in a single PDF via email to scholarships@youngicca.org by August 30, 2024.

ICC Dispute Resolution Bulletin Publishes “Two Recent New York Federal Court Decisions Highlight the Federal Circuit Split on Whether the McCarren-Ferguson Act Allows State Insurance Laws to Override the New York Convention” by Andrew Poplinger and Thomas Hildebrand

May 2024—Chaffetz Lindsey’s Andrew Poplinger and Thomas Hildebrand authored an article in the first issue of the 2024 ICC Dispute Resolution Bulletin.

The article discusses how recent decisions from the Southern District of New York highlight the conflicting approaches taken by federal appellate courts on the issue of whether the McCarren-Ferguson Act permits state insurance laws to invalidate arbitration agreements governed by the New York Convention.

Anibal Sabater and Agustina Alfaro Contribute to SVAMC Guidelines on the Use of Artificial Intelligence in Arbitration

May 2024—The Silicon Valley Arbitration & Mediation Center (SVAMC) Artificial Intelligence Task Force published this week its Guidelines on the Use of Artificial Intelligence in Arbitration. Chaffetz Lindsey’s Aníbal Sabater and Agustina Alfaro actively participated in the process.

The SVAMC AI Guidelines provide a set of principles to ensure the fair and ethical application of AI in arbitration proceedings as AI use continues to grow in the legal field. A first draft of the Guidelines was published in August 2023 along with an invitation for comments. Earlier this year, a Guidelines Review Committee was formed to collate and decide on the implementation of the comments received to the draft. Aníbal was a member of the Guidelines Review Committee and and Agustina Alfaro its administrative assistant.

Matilde Flores Elected Co-Chair of ASIL Latin America Interest Group

April 2024—Chaffetz Lindsey’s Matilde Flores has been elected co-chair of the Latin America Interest Group at the American Society of International Law (ASIL) for a two-year term.

The Latin America Interest Group provides a forum on Latin America and international law. The Group promotes discussion and reflection on a broad spectrum of contemporary issues of importance to the region organizing roundtables, panels, meetings, and other events.

IBA Arbitration Committee Releases 2024 Guidelines on Conflicts of Interest in International Arbitration

March 2024— The IBA Arbitration Committee announced the Committee’s publication of the 2024 Guidelines on Conflicts of Interest in International Arbitration. Chaffetz Lindsey’s David Blackman is secretary and member of the Task Force for the Revision of the 2014 Guidelines.

The first IBA Guidelines on Conflicts of Interest in International Arbitration (the ‘Guidelines’) were prepared by the IBA Arbitration Committee and adopted by the IBA Council in 2004. They immediately gained wide acceptance within the international arbitration community and have been recognized as an important soft law instrument that reflects general standards regarding conflicts of interest and disclosures for arbitrators in international arbitrations.  Consistent with the IBA Arbitration Committee’s practice of assessing every ten years whether its rules and guidelines should be adapted, the Guidelines were first revised in 2014.

The Introduction to the 2024 Guidelines describes the overreaching goals of the Guidelines and their latest revision, followed by the General Standards regarding impartiality, independence and disclosure that must always be considered, and the Application Lists that illustrate the practical application of the General Standards by way of specific situations.

Chaffetz Lindsey Launches New York Appellate Insurance Reports (NYAIR)

February 2024 ─ Chaffetz Lindsey is excited to launch of a new firm publication, the New York Appellate Insurance Reports (NYAIR). NYAIR will provide timely summaries of New York appellate court and Second Circuit decisions concerning complex commercial insurance and reinsurance disputes. Coverage includes decisions back to January 1, 2023 and we will add new reports as future decisions are handed down.

New York is a commercial and insurance hub, and the decisions of its appellate courts shape the national and global insurance industry. We created NYAIR to stay abreast of breaking developments on complex insurance disputes and to share that information with our industry-leading clients and colleagues.

Chaffetz Lindsey Promotes Erin Valentine to Partner

January 2024 – Chaffetz Lindsey is pleased to announce that Erin Valentine has been promoted to Partner, effective January 1, 2024.

Erin has been an integral part of the Chaffetz Lindsey team for nearly the entire duration of the firm’s existence, showcasing exceptional skills and dedication in advising individual and corporate clients on disputes in U.S. courts and before arbitral tribunals. Her extensive experience includes managing complex commercial litigation, bankruptcy adversary proceedings, and international arbitrations in a diverse range of industries including insurance, construction, energy, entertainment, education, pharmaceuticals, and financial services. Erin has successfully represented insurance companies in complex coverage disputes, a foreign sovereign in ICC arbitration against a private tertiary education provider, and a Swiss financial institution in a series of bankruptcy adversary proceedings. Her accomplishments also include overturning a jury verdict in a Second Circuit Appeal in favor of a global reinsurer and representing a Bermuda fund manager and individual directors in fraud-related proceedings.

“Erin has been a mainstay of the firm since the beginning.  She has contributed valuable work across our litigation, insurance, and insolvency practices.  Equally important, through her deep understanding of our business, the needs of our clients, and those we work with around the world, she has had a crucial role in developing our practice and expanding our network.  We are proud to welcome her to the partnership,” said Founding Partner Peter Chaffetz.

Erin is Adjunct Faculty at Fordham University School of Law, where she teaches international civil litigation to LLM students. She is actively involved in the legal community, holding leadership positions at the New York State and City Bar Associations, and participating in organizations such as the International Fraud Group, ArbitralWomen, and the American Bar Association.

Erin has demonstrated a commitment to pro bono. She currently represents clients in asylum proceedings, and she previously represented the United Nations Special Rapporteur on Torture before the U.S. Supreme Court. Prior to joining Chaffetz Lindsey, Erin was legal counsel at International Justice Network, representing individuals detained at the United States airbase in Bagram, Afghanistan, in habeas proceedings in both district and appellate courts.

Erin earned her J.D. from University of Pennsylvania Law School, where she was a James Wilson Scholar, Senior Editor of the University of Pennsylvania Journal of International Law, winner of the Blank Rome Alvin Ackerman Prize, and recipient of the Pro Bono Service Recognition Award. She received her B.A. from University of California, Irvine.

Caline Mouawad and Gretta Walters Publish Chapter in Kluwer Law International’s “Investment Arbitration and Climate Change”

January 2024—Chaffetz Lindsey’s Caline Mouawad and Gretta Walters have published a chapter in Kluwer Law International’s “Investment Arbitration and Climate Change.” The publication stands to be a comprehensive elaboration where experts and practitioners describe different types of climate-related investment disputes, provide a thorough analysis of the unique procedural issues that emerge in such disputes, and evaluate the proper balance between States’ right to regulate to fight climate change and their obligations towards foreign investors.

Caline’s and Gretta’s chapter titled “Climate Science: A Role to Play at Every Stage of Investment Arbitration?” examines how climate science may come into play at various points in the life of an investment arbitration:  i) at the threshold phase, when tribunals assess whether a covered investment or admissible claim exists; ii) at the liability phase, when a State’s sovereign right to regulate for climate change mitigation or adaptation may come up against its investment treaty obligations; and iii) at the damages phase, when compensation may be measured in light of the moral imperative of reducing emissions.  This chapter examines the role that climate science may play, if any, at each of these stages of an investor-state arbitration.

Gretta Walters to Teach AAA-ICDR CLE Course

January 2024—Chaffetz Lindsey’s Gretta Walters will co-teach two courses as part of AAA-ICDR’s CLE webinar “International Commercial Law and Practice: A Deep Dive for American Litigators and In-House Counsel” January 18th-January 19th.

During the event, attendees will become knowledgeable about the law and practice of international commercial arbitration seated in the United States. Topics will include applicable law, arbitrability, stays and orders compelling arbitration, the administration of an international case with a focus on ICDR® practices, cross-examination technique, ethical obligations of counsel and arbitrators, form and necessary content of awards, confirmation and set aside of awards, and enforcement of awards.

The first course taking place on January 18th will cover “Cross-Examination: International vs. Domestic U.S. Practice” from 1:30pm-2:30pm. The next day Gretta will co-teach a course on “Set Aside, Recognition and Enforcement” from 12:20pm-1:30pm.

ICC Dispute Resolution Bulletin Publishes “Optional Provisions for the Terms of Reference and Procedural Order No. 1” by Anibal Sabater

January 2024—Chaffetz Lindsey’s Anibal Sabater authored an article in the third edition of the 2023 ICC Dispute Resolution Bulletin. The article titled “Optional Provisions for the Terms of Reference and Procedural Order No. 1” outlines provisions beyond the standard content that the arbitral tribunal may wish to discuss with the parties on (1) the arbitral tribunal, (2) counsel, (3) scheduling issues, (4) evidence, and (5) other matters.

The piece aims to capture the most significant provisions that can be found in practice, which will adapt as international arbitration practice continues to develop in the future.
