April 2017 – HILSA has invited Chaffetz Lindsey partner Aníbal Sabater to give a talk on Friday, April 14th titled “In Search for the Perfect Arbitrator: Trier of Facts, Appellate Lawyer, or Both?”

The recent surge in rules and soft law concerning arbitrator behavior and qualifications appears to emphasize the importance of procedure over results, of form over substance.  Is the arbitration community neglecting the importance of having arbitrators who, in addition to knowing the law, can tell when a witness is lying or when a party is holding a commercially unreasonable position?

Aníbal is an international arbitration specialist with over 20 years of experience, representing clients from around the world and industries as diverse as construction, energy, mining, shipping, technology, and telecommunications, in arbitrations under all major international arbitration rules, including AAA/ICDR, ICC, LCIA, and UNCITRAL. He has also acted in several investment arbitration cases under the UNCITRAL Rules and the ICSID Convention/Rules, as well as in commercial disputes involving states and state-owned entities. Yasmine Lahlou Speaks at 5th ICC Middle East-North Africa Conference on Arbitration

April 2017 – The ICC recently held their Fifth Annual ICC Middle East-North Africa (MENA) Conference on Arbitration in Dubai over April 3-5, 2017.  The conference presented a series of discussions on the latest arbitration developments in the MENA region as well as an advanced level training on oral advocacy in international arbitration.

Chaffetz Lindsey partner Yasmine Lahlou spoke on a panel titled “Parallel proceedings, tactics and remedies: Overview of available options, prevailing practices and anti-suit injunctions.”  Her co-panelists were Andrea Carlevaris of the ICC International Court of Arbitration, Alexander B. Blumrosen of Kuckenburg Bureth Boineau et Associés, and Anne K. Hoffmann of Clyde & Co.

Yasmine advises and represents US and international clients on a range of commercial disputes, in both international arbitration and litigation proceedings. Initially trained in Paris and admitted in New York, Yasmine is experienced in civil and common law systems.  She has represented clients in arbitration proceedings conducted under the ICC, ICDR, LCIA, UNCITRAL and ad hoc rules, as well as acted as an arbitrator.

Gretta Walters to Speak at 2017 ICDR Y&I Coffee House in Vienna

March 2017 – Chaffetz Lindsey will be sponsoring the 13th Annual ICDR Y&I Coffee House Debate at which associate Gretta Walters will be speaking.  The ICDR Y&I event takes place annually on the event of the Willem C. Vis International Commercial Arbitration Moot in Vienna, Austria.

The event will take place on April 9, 2017 at the Palais Daun-Kinsky, located at Freyung 4, Vienna, Austria.  Registration will begin at 12:00 with the debate taking place from 12:30-14:30.  The two debate propositions are:

  • You spilled my coffee – I’m not paying for you!  Debate proposition:  A party allegedly harmed by another’s conduct shouldn’t have to advance the other’s costs just to get justice.
  • Waiter, just bring our coffees and stay out of it!  Debate proposition: The increased power of arbitral institutions has come at the expense of party autonomy.

Steven Reisberg Moderates International CIArb Panel “Arbitrating Patent Disputes”

March 2017 – The European, New York, and North American Branches of the Chartered Institute of Arbitrators joined forces to host a four-location, video-linked conference on March 22nd, featuring speakers from the United States and Europe, that focused on the topic of “Arbitrating Patent Disputes: Innovative Approaches and New Concerns” at which Chaffetz Lindsey partner Steven Reisberg served as a panel moderator.

Steven’s panel (one of two), titled “Patent Law: A Public Policy Basis for Vacatur?” examined the circumstances under which a patent arbitration award may (or should) be denied recognition or enforcement under the public policy exception of Article V of the New York Convention. Topics discussed included how the public policy exception has been interpreted by American and European courts; what aspects of patent law, if any, qualify as Mandatory Law; and the intersection of patent and competition law. Panelists included Annet van Hooft (Bird & Bird, Paris), Sherman Kahn (Mauriel Kapouytian Woods LLP, New York), Grant L. Kim (LimNexus LLP, San Francisco) and Charles R. Macedo, (Amster, Rothstein & Ebenstein, LLP, New York).

Morrison & Foerster LLP hosted the San Francisco, Palo Alto, and New York locations, while the Arbitration and Mediation Center of the World Intellectual Property Organization hosted a group in Geneva.

James Hosking to Speak on International Construction Arbitration at iLaw2017

February 2017 – James Hosking, partner and co-founder at Chaffetz Lindsey, will present at iLaw2017, the ILS Global Forum on International Law, newly rebranded from the former “ILAT,” being held on February 17, 2017 at the Conrad Hotel in Miami.

James’s panel, titled “International Construction Arbitration Trends and Best Practices,” will discuss how the practice area continues to grow, leading the ICDR’s caseload five of the last six years. This panel — which includes John Fellas (Hughes Hubbard & Reed LLP, New York), Mauricio Gomm Santos (GST LLP, Miami), Alvin F. Lindsay III (Hogan Lovells, Miami), and Shelly L. Ewald (Watt Tieder Hoffar & Fitzgerald, McLean, VA) — will focus on international arbitration as a conflict-management tool increasingly being utilized to resolve disputes in this growing and evolving industry. The experts will discuss the unique aspects of issues that may arise during the course of an international arbitration of a dispute stemming from a construction or infrastructure project.

The panel moderator will be Mariela Malfeld, Watt, Tieder, Hoffar & Fitzgerald (Miami).

Gretta Walters to speak at International Congress of Arbitration of ICC Costa Rica

February 2017 – Gretta Walters will be a panelist at the February 2017 VIII International Congress of Arbitration of ICC Costa Rica taking place at the Hotel Marriott Costa Rica.  The Congress, this year titled “Arbitration in Ibero-America: Have We Innovated?” will cover topics such as recent developments in investment arbitration in Ibero-America and will review the cases that have marked the agenda. In addition, discussions will be included on the calculation of compensation and ethical dilemmas.

Gretta’s panel, taking place from 2:30pm to 4pm on Thursday, Feb. 23rd, is titled “Innovation in arbitration” and will focus on topics such as technology use, training, costs, openness in referee lists, gender issues, and more. José Astigarraga (Astigarraga Davis, Miami) is leading the discussion.

Gretta has experience representing individual and corporate clients in arbitration in international and cross-border disputes and in complex litigation matters in state and federal court.

Aníbal Sabater to Speak at NYSBA’s In Camera Breakfast Series

December 2016 – NYSBA’s International Dispute Resolution Committee, in cooperation with NYIAC, the Chartered Institute of Arbitrators’ New York Branch, Dorsey & Whitney, White & Case, and Arbitration Place, is hosting the third and final segment of a three-part series on the inner workings of arbitral tribunals.

Aníbal Sabater is one of the speakers at the The In Camera Breakfast Series on the topic of Ethical Issues and Misconduct (other speakers include Christian Alberti, ICDR; Jennifer Kirby, Kirby Arbitration; Luis Martinez, ICDR; and David Singer, Dorsey & Whitney LLP (moderator)).

Previous sessions explored different approaches to building tribunal cohesion and collegiality, organizing deliberations, and delegating responsibilities among tribunal members and to tribunal assistants.  This final seminar will address how tribunals deal with arbitrator misconduct and ethical issues vis-à-vis arbitrators.  This series offers a unique opportunity for counsel to better understand how tribunals make decisions and for arbitrators to consider how they might be more effective as co-arbitrators or chairs.

The breakfast will take place on Wednesday, December 14, 2016, from 8:30-10:00am at the office of Dorsey & Whitney LLP at 51 W. 52nd Street, New York.

Gretta Walters To Speak At 8th Conference on Teaching Transnational Commercial Law

November 2016 – Gretta Walters will be speaking on Arbitral Institutions, Roles and Activities at the 8th Conference on Teaching Transnational Commercial Law, taking place November 17th and 18th at Georgetown University in Washington DC.

The conference (and optional Saturday program) will take place Thursday and Friday at the International Law Institute, located in Georgetown at 1055 Thomas Jefferson St. NW (Suite M-100), Washington, D.C.  20007.

The conference is organized by the Center on Transnational Business and the Law at Georgetown University Law Center (part of the Institute on International Economic Law) and hosted by the International Law Institute. Cosponsors include the American Branch of the International Law Association.

Aníbal Sabater to Present on “Economic Sanctions and International Arbitration” at UIA’s 60th Congress in Budapest

October 2016 – Aníbal Sabater will be presenting on Saturday, October 29th at the International Association of Lawyers’ (UIA – Union Internationale des Avocats) 60th Annual Congress in Budapest, Hungary.

Aníbal will be addressing the topic of Economic Sanctions and International Arbitration along with panelists Patricia Ann Peterson, Mathias Audit, Anne-Carole Cremades, Vladimir Khvalei, András Szecskay, Jane Willems, Delphine Wietek, William Laurence Craig, and Nadia Darwazeh.

This session will focus on legal and practical considerations in addressing issues arising from economic sanctions. The program will consist of two panels. The first will examine the notion of economic sanctions, their sources and their relevance to international arbitration. The topic will be approached from the perspectives of counsel, arbitrator and arbitral institution.

The second panel will look at the impact of economic sanctions on a dispute when applied as the lex contractus or as mandatory law, the enforcement of sanctions ordered by arbitrators and various issues related to the enforcement of arbitral awards.

David Lindsey to Speak on International Arbitration at NY City Bar Event

September 2016 – David Lindsey, partner and co-founder of Chaffetz Lindsey, will speak tonight at the New York City Bar’s “Hot Practice Areas: Privacy/Cybersecurity, Investment Funds, International Arbitration, Securities Litigation” event taking place at 42 West 44th Street in New York, NY.

David will discuss the legal specialty of International Arbitration; the path that led him to this specialty; the types of matters to expect in this area; determining whether this area might be of interest; the skills he has used/developed; the advantages/disadvantages of specializing; long-term possibilities, including firm, in-house, and public sector options; and how to enter or transition into this area.

Aníbal Sabater to Speak at Latin Lawyer 7th Annual Private Equity Conference

September 2016 – Aníbal Sabater, Chaffetz Lindsey partner and  international arbitration specialist, will be a speaker at the Latin Lawyer Private Equity Conference taking place in New York on Monday, September 26th.  His panel, titled “Beauty and the Beast: From populism to orthodoxy,” will discuss what has been the experience for investors in various Latin American jurisdictions with expropriations or rule changes.  More specifically:

  • Argentina: what has been the balance of Argentina’s populist adventure? The Macri Era – a feasible, new beginning?
  • Venezuela: experience in nationalization and investment treaty arbitration
  • Functioning of investment treaties to hedge sovereign risk
  • SEC listing as hedge of sovereign risk?
