Three Chaffetz Lindsey Members Among Arbitration Lawyers to Launch New Association Focused on the Arab World

November 2022— Chaffetz Lindsey senior associate May Khoury is among five international arbitration practitioners that are joining forces to launch “ArabArb”, an independent network that aims to unite, promote, and serve the U.S.-based arbitration community with roots, affinity, or interest in the Arab World. Founders of the organization include Randa Adra, partner at Crowell & Moring; Cherine Foty, senior associate at Covington & Burling in Washington, DC; Lillian Khoury, senior associate at Steptoe & Johnson in New York; and Nour Nicolas, associate at Foley Hoag in New York.

Chaffetz Lindsey partners Caline Mouawad and Yasmine Lahlou will sit on the advisory committee of this women-led group, making three out of eleven members represented by the Chaffetz Lindsey team.

Additional advisory committee members include Meriam Al-Rashid, global co-chair of International Arbitration at Eversheds Sutherland; Amal Bouchenaki, partner at Herbert Smith Freehills; Maria Chedid, global co-chair of the International Arbitration Group at Arnold & Porter; and Samaa Haridi, partner at King & Spalding.

ArabArb’s mission is to create a platform for members to connect and collaborate with fellow practitioners as well as advance the knowledge and understanding of international arbitration as it relates to the Arab World. The group will work to increase the visibility of diverse and qualified counsel, arbitrators, and experts who are particularly suited to handle disputes relating to the Arab World.

ArabArb will host a launch event in New York City on November 16, 2022 during New York Arbitration Week to introduce itself to the legal community, present its mission, and welcome new members. The group plans to organize conferences and training seminars on topics relevant to the community, as well as offer mentoring opportunities and exposure to law students of Arab descent. ICC Dispute Resolution Bulletin Publishes Article on Judicial Review of Arbitral Jurisdiction in the U.S. and Germany

October 2022— An article authored by Chaffetz Lindsey’s Andreas Frischknecht, Alex Lupsaiu and former visiting law clerk Greta Körner has just been published in the second issue of the 2022 ICC Dispute Resolution Bulletin.

The article, titled ”Who Decides? Judicial Review of Arbitral Jurisdiction in the U.S. and Germany — particularly under Article V(1)(c) of the New York Convention,” examines how courts in the United States and Germany differ fundamentally in their approach to arbitral jurisdiction and the degree to which it is subject to judicial review.

But, nonetheless, the authors find that the practical outcomes in both jurisdictions are more similar than the stark differences in theory might suggest.

James Hosking Elected to ICCA’s Governing Board for Four-Year Term Beginning April 2022

February 2020— Chaffetz Lindsey’s James Hosking one of nine new members recently elected to the International Council for Commercial Arbitration (ICCA) Governing Board. ICCA is a world-wide organization devoted to promoting the use and improving the processes of arbitration, conciliation and other forms of dispute resolution. ICCA Members come from over 95 countries, and the organization is led by an international Governing Board of 40 prominent dispute resolution specialists representing 26 nationalities.

In a press release announcing the new Governing Board members, ICCA President Lucy Reed commented, “I could not be more pleased with the new ICCA leaders. The 9 new Members of the Governing Board, like the outgoing GB Members – whom I thank profusely for their commitment and work – will bring a wealth of international arbitration experience and wisdom to ICCA.”

James will sit on the board for a four-year term beginning April 2022.

ITA in Review Publishes Alicia Yeo’s Report on the “Arbitration & Insolvency: When Theory Meets Practice” Panel

February 2022 — ITA in Review’s newest edition features a report by Chaffetz Lindsey’s Alicia Yeo on the panel webinar “Arbitration & Insolvency: When Theory Meets Practice,” which was hosted by Young Practitioners’ Group of the Institute for Transnational Arbitration (“Young ITA”) in October 2021. The webinar was organized and moderated by Lidia Rezende, Chaffetz Lindsey attorney and Young ITA’s North America Chair.

The webinar explored practical issues that arise at the intersection of insolvency and arbitration, from both Brazilian and U.S. law perspectives. The discussion centered on three topics that often arise in the international arbitration and insolvency space:  (1) the right to initiate arbitration when insolvency procedures are involved; (2) the viability of arbitration proceedings brought by insolvent parties, particularly with regard to security for costs; and (3) the enforceability of arbitral awards by or against insolvent parties.  Panelists included Ruth Teitelbaum, Eduardo A. Mattar, Jennifer Permesly, and André Luis Monteiro.

Aníbal Sabater Discusses LatAm Policy Changes’ Impact on International Arbitration: Towards Harmony or Dissonance?

May 2020 – On Thursday, April 30th, Aníbal Sabater joined Noiana Marigo of Freshfields Bruckhaus Deringer LLP and Rekha Rangachari of NYIAC in a well-attended live podcast discussion titled “Change within the System: Mexico, Ecuador and Argentina.” The podcast is the first of a three part series hosted by New York International Arbitration Center (NYIAC), exploring how the dueling dynamic and policy changes across Latin American jurisdictions impact international arbitration. Anibal and Noiana discussed the effects of legal developments on ideological and power structures, new constitutional processes, and the role of infrastructure on progress.

Aníbal also examines the economic and political impact of the pandemic on Latin American countries, and the potential short and long-term effects on commercial and investment arbitration in the region.

According to Anibal, “COVID-19 is creating challenges and uncertainty for international arbitration practitioners across Latin America, but it is also generating opportunities.”  His article is an early attempt at analysis and prediction.
