James Hosking to Debate the Desirability of Arbitrator Challenges at 33rd Annual ITA Workshop and Annual Meeting

June 2021 – On Wednesday, June 16, at 2:10pm EST, James Hosking will participate in a mock debate at the 33rd Annual ITA Workshop and Annual Meeting. James will argue for the motion: “Challenges of Arbitrators Have Been on the Rise, Often for Tactical Reasons, and They Should Be Discouraged.” James will square-off against the formidable Melanie van Leeuwen of Derains Gharavi (Paris), in a debate moderated by Prof. Chiara Giorgetti of University of Richmond School of Law (Washington D.C.).  The (virtual) audience will get to determine who won the motion so be sure to register here.

Founded in 1986, the Institute for Transnational Arbitration (ITA) was created to educate business executives, government officials and lawyers about arbitration as a means of resolving transnational business disputes and to promote global adherence to the world’s principal arbitration treaties. The Annual Workshop is a highlight of the arbitration calendar in the United States.

Gretta Walters to Speak About Discovery Under Section 1782 at the Inaugural ABA International Litigation Skills Conference

May 2021 – On Wednesday, May 26th, Gretta Walters will participate in a panel discussion at the ABA International Law Section’s inaugural International Litigation Skills Conference. Gretta will join other panelists to discuss, “Discovery Under Section 1782: The Latest Developments,” which will feature insights on recent developments, including the issue currently before the Supreme Court on applicability of Section 1782 to international commercial arbitration.

Aníbal Sabater to Speak About International Arbitration in Latin America for SCL NA

May 2021 – On May 27th, Aníbal Sabater will participate in a panel discussion titled, “Arbitraje Internacional, perspectiva y opiniones sobre la región LATAM.” Aníbal will join co-panelist, Mario Reggiardo of Payet, Rey, Cauvi, Perez Abogados and moderator Andres Alva of Berkeley Research Group, to discuss the use of technology, COVID-19 impacts, dispute panels and corruption impacts in international arbitration in Latin America.

Gretta Walters to Speak for YAWP About Climate Change, Outer Space and Human Rights Opportunities for Arbitration Lawyers

May 2021 – On Tuesday, May 25th, Gretta Walters will participate in a panel discussion hosted by Young ArbitralWomen Practitioners (“YAWP”) titled, “New Opportunities for Arbitration Lawyers: Climate Change, Outer Space and Human Rights.” Gretta and her co-panelists, Krystle Baptista Serna (Independent Arbitrator) and Laura Yvonne Zielinski (Holland & Knight LLP), will address how international arbitration is becoming increasingly relevant as a means for dispute resolution in issues relating to climate change, outer space and human rights.

May 2021 – On Wednesday, May 26th, James Hosking and Gretta Walters will participate in a panel discussion titled, “The ICDR’s Revised International Arbitration Rules – Inspirations, Interpretations and Insights.” Gretta will moderate the discussion between James, Martin Gusy and the ICDR’s Luis Martinez. The panelists will provide arbitrator, counsel and institutional perspectives on the latest iteration of the ICDR Rules, analyzing what changed, what remained the same, and how the changes compare to other rules. May 2021 – Chaffetz Lindsey was a proud sponsor of the ARIAS U.S. 2021 Virtual Spring Conference.

The ARIAS’ Women’s Resource Committee kicked-off the conference on May 5th with a virtual chocolate tasting, sampling a variety of chocolates from Dallmann Confections. On Thursday May 6th, Cia Moss moderated a panel discussion titled “Reinsurance of COVID-19 Claims: The More Things Change, the More They Stay the Same.” The panel discussed the reinsurance disputes that could arise from the pandemic and examined how industry precedent might guide resolution of such disputes.  And on Friday, May 7th, Steven Schwartz, who is Chair of the ARIAS Board of Directors, delivered the closing remarks.

Chaffetz Lindsey is an active ARIAS participant—Steve is Chairman of the ARIAS Board of Directors and Cia is a member of the organization’s Strategic Planning, Law, and Women’s Resource Committees.

ARIAS-US is a nonprofit corporation dedicated to improving the insurance and reinsurance arbitration process for the international and domestic markets. The organization hosts a Spring and Fall Conference to provide training and continuing education in the skills necessary to serve on an insurance/reinsurance arbitration panel.

Aníbal Sabater and Yasmine Lahlou to Serve as Faculty at the 2021 ABA’s Section of International Law Arbitration Skills Masterclass

April 2021 – On May 5th – 6th, Aníbal Sabater and Yasmine Lahlou will each speak at the ABA’s Section of International Law Arbitration Skills Masterclass, a hands-on training program designed to help students and practitioners develop arbitral skills. During the two-day virtual conference, each participant will have the opportunity to learn and practice the best methods, techniques and dos and don’ts for conducting a merits hearing, plus conduct cross-examination and re-direct examination of witnesses (‘played’ by law school students) and experts (‘played’ by damages experts from prominent consultancy firms).

In addition to the practice and feedback sessions, Aníbal and Yasmine will also participate in panel discussions. On Wednesday, May 5th (11:30am – 12:30pm EST) Aníbal is speaking on a panel about “Plenary Presentation on Cross-Examining and Redirecting Fact Witnesses.” On Thursday, May 6th (9:00am – 9:30am EST) Yasmine is moderating a panel discussion titled, “Plenary Presentation on Cross-Examining and Redirecting Expert Witnesses.”

Andy Frischknecht to Speak on “Litigating Remotely” at IBA Litigation Committee Virtual Conference

April 2021 – On Tuesday, May 4th, Andy Frischknecht will participate in a panel discussion titled, “Litigating Remotely – Pros, Cons, Hints and Tips.” Andy will join senior litigators from Canada, the United Kingdom and Russia to discuss how they have adjusted to litigating in a virtual environment and analyze best practices when litigating remotely. The panel will also include an Ontario Superior Court Justice’s perspective on things counsel should keep in mind when appearing virtually in court. The webinar is the first of four to take place in May as part of the “New Challenges in Multi-Jurisdictional Litigation” virtual conference hosted by the IBA Litigation Committee. The conference will bring together remotely practitioners from around the world to discuss hot topics in commercial litigation.

The IBA Litigation Committee meets annually at the main IBA Conference and a specialist litigation conference to exchange ideas on legal, practical and procedural aspects of litigation, with a particular focus on cross-border issues such as jurisdiction, choice of law, and the role of international judicial assistance in dispute resolution. Gretta Walters a Panelist at 16th Annual ICDR Y&I Coffee House Debate

March 2021 — The 16th Annual ICDR Y&I Coffee House Debate is taking place virtually on Sunday, March 28th from 9am to 10:30am EDT.  Chaffetz Lindsey’s Gretta Walters will serve as one of six panelists who will debate the following topics, taking positions which do not necessarily reflect their personal views:

Yasmine Lahlou and Caline Mouawad to Speak at 2021 ASIL Annual Meeting

March 2021 – On Wednesday March 24th, Yasmine Lahlou and Caline Mouawad will each speak at the American Society of International Law’s (ASIL) 2021 Virtual Annual Meeting.

Yasmine will participate in a mock Supreme Court argument on “Should Courts Grant Discovery in Aid of Arbitration?” During the mock argument, advocates will present conflicting views from US district and appellate courts about obtaining evidence in aid of private international arbitration and incorporate insights into how courts from other countries allow or restrict discovery for use in arbitration. The panel could not be more timely as the Supreme Court just granted certiorari to address that specific question. The session begins at 12:30pm EST.

Caline will participate in a debate on the motion: “Parallel Proceedings in Investment Arbitration Are Abusive and Should be Banned.” Caline will join other panelists to hear arguments on the motion, which will address the increase in parallel proceedings in investor-state arbitrations, argue for and against the abusiveness of these proceedings, and discuss recent reform proposals aimed at addressing them.  The session begins at 1:45pm EST.

Aníbal Sabater to Speak about E-Discovery at the Hispanic National Bar Association’s Corporate Counsel Conference

March 2021 – On Wednesday, March 17th, Aníbal Sabater will participate in a panel discussion titled “E-Discovery in International and Domestic Arbitration v. E-Discovery in Court” at the 2021 Hispanic National Bar Association’s Corporate Counsel Conference. Aníbal will join panelists Hon. Ariel Belen (JAMS), Dawson Horn (AIG), Katherine Coba (Boyd Richards) and Michael Fernandez (Winston & Strawn) to explore the different approaches courts and arbitral providers are taking to e-discovery and share practical tips for effective and efficient e-discovery.  The panel will also discuss recent circuit split on 28 U.S.C. 1782 and the effect on e-Discovery in private International commercial arbitrations.
