Silvia Marroquin to Speak at Harvard International Arbitration Conference

January 2024—Chaffetz Lindsey’s Silvia Marroquin will moderate a panel at the upcoming 10th Annual Harvard International Arbitration Conference on Thursday, February, 1st.

Silvia will be joined by Suzana Blades (Kimberly-Clark), Karl Hennessee (Airbus) and Jared Hubbard (Scytáles AB) for the panel “The Crises of Arbitration: An In-House Perspective.”

Marcel Engholm to speak at Georgetown Brazilian Arbitration Day

January 2024—Chaffetz Lindsey’s Marcel Engholm will speak at Georgetown Brazilian Arbitration Day on Wednesday, January 24th. Marcel will join Pedro Maciel (Lefosse Advogados), Mauricio Gomm Santos (GST) and Erica Franzetti (King & Spalding) for the panel “Considerations about the Seat of Arbitration.” The discussion will be moderated by Gustavo Ramos (Georgetown).

The event will be held at Freshfields Bruckhaus Deringer LLP in Washington D.C. and is organized by the Georgetown Brazilian Law Association and the Georgetown International Arbitration Society.

Gretta Walters to Teach AAA-ICDR CLE Course

January 2024—Chaffetz Lindsey’s Gretta Walters will co-teach two courses as part of AAA-ICDR’s CLE webinar “International Commercial Law and Practice: A Deep Dive for American Litigators and In-House Counsel” January 18th-January 19th.

During the event, attendees will become knowledgeable about the law and practice of international commercial arbitration seated in the United States. Topics will include applicable law, arbitrability, stays and orders compelling arbitration, the administration of an international case with a focus on ICDR® practices, cross-examination technique, ethical obligations of counsel and arbitrators, form and necessary content of awards, confirmation and set aside of awards, and enforcement of awards.

The first course taking place on January 18th will cover “Cross-Examination: International vs. Domestic U.S. Practice” from 1:30pm-2:30pm. The next day Gretta will co-teach a course on “Set Aside, Recognition and Enforcement” from 12:20pm-1:30pm.

James Hosking Delivers Keynote Address “Arbitration Law in the United States: Adventures in Barbie Land” at Miami Arbitration Week

January 2024— Chaffetz Lindsey’s James Hosking gave the keynote address at the recent kick-off event for the inaugural Miami Arbitration Week.  In his speech – “Arbitration Law in the United States: Adventures in Barbie Land” – he took inspiration from the blockbuster Barbie movie, to argue that like Barbie, international arbitration law is suffering from an existential crisis.  The speech set the scene for a panel discussion on the impact of legislation and court reform on arbitration friendliness in the Americas.

Karina Miranda Speaks on CAM AMCHAM Panel

December 2023—Chaffetz Lindsey’s Karina Miranda recently spoke on the panel “Carreiras Pós-LL.M.” (“Careers Post-LLM”). The event, organized by the Arbitration and Mediation Center of the American Chamber of Commerce in Brazil, took place virtually on Monday, November 27th. Karina was joined by Guilherme Guidi (Castro Barros) and Laura França Pereira (Three Crowns) to discuss careers in arbitration. Luis Henrique Fernandes (Pinheiro Neto Advogados) moderated the discussion.

Matilde Flores to Speak on ICDR Y&I International Construction Arbitration Series

December 2023—Chaffetz Lindsey’s Matilde Flores will join a panel for the ICDR Y&I 2023 International Construction Arbitration series “International Construction Arbitration: Core Concepts for Arbitration Practitioners” taking place Wednesday, December 13th. Construction experts from around the world will discuss the core concepts young arbitration practitioners should understand when tasked with overseeing complex construction disputes.

Matilde will join Meera Wagman (Secretariat) and Emily Elliott (White & Case) for a conversation on ”The Nuts and Bolts of Delay Analysis.”  Giorgio A. Sassine (Musick, Peeler & Garrett) will moderate the discussion. The webinar will focus on introducing audience members to the more granular issues associated with schedule and delay analysis. Panelist will discuss, among other things, the practice of project scheduling, the methods delay experts implement to measure project delays, and how those methods factor into delay claims in connection with construction arbitrations.

Caline Mouawad to Speak at International Court of Arbitration (ICC) Annual Events

November 2023—Chaffetz Lindsey’s Caline Mouawad will participate in the ICC Institute Annual Colloquium on Monday, November 27th and the ICC Institute of World Business Law Annual Conference on Tuesday, November 28th.

The 26th Annual Colloquium of the ICC Institute of World Business Law “Arbitrators in Corporate Disputes: How far can they go?” is a members-only event held at the ICC Global Headquarters in Paris, France. The Colloquium will explore the limits of arbitrators’ powers in resolving corporate disputes and will be introduced by Institute members Olivier Caprasse, Caline Mouawad and José Maria Perez.

The next day, Caline will speak on a panel at the 43rd ICC Institute of World Business Law Annual Conference. The conference titled “Good Faith in International Arbitration: A Versatile Chameleon?” will assess when good faith comes into play at various stages of the international arbitration process and examine the efficacy and limitations of good faith as a legal tool supporting the arbitral process. The conference will take place in Paris, France at Les Salons de l’Hôtel des Arts et Métiers.

Caline will join the Tuesday afternoon panel “Good Faith in Investment Arbitration: What’s different?” and moderate a discussion between Laurie Achtouk-Spivak (Cleary Gottlieb), Sabrina Aïnouz (Squire Patton Boggs), Kabir Duggal (Arnold & Porter) and Samantha Rowe (Debevoise & Plimpton). The session will look at the importance of the good faith principle in international investment law, and how it affects and guides the tribunal’s consideration of the parties’ conduct and arguments at different stages of the proceeding, from making the investment, pre-dispute admissibility requirements, jurisdictional elements, and on the merits of the claims.

Yasmine Lahlou to Speak at VII Oxford Arbitration Day

November 2023—Chaffetz Lindsey’s Yasmine Lahlou will speak at the upcoming VII Oxford Arbitration Day on Friday, November 24th. The event, taking place at the University of Oxford, is it is co-organized by the Commercial Law Centre (University of Oxford), the Oxford International Arbitration Society, the EDUCA Foundation, and Canal Arbitragem.

The event is comprised of four panels, with 19 speakers and 4 moderators, discussing (i) arbitration and insolvency, (ii) ethics in international arbitration, (iii) energy disputes and international sanctions, and (iv) climate change and ESG disputes. The final session is a fireside chat with Paula Hodges KC and Eduardo Silva Romero.

Marcel Engholm to Speak at Université Côte d’Azur Conference

November 2023– Chaffetz Lindsey’s Marcel Engholm will speak at the upcoming conference “La Justice à la Croisée des Chemins: entre marchandisation et algorithmization” (“Justice at a Crossroads: between commodification and algorithmization”) on Monday, November 20th. The event, hosted by the Universite Côte d’Azur under the direction of Gustavo Cerqueira (Université Côte d’Azur) and Marina Teller (Université Côte d’Azur) will take place from November 20th-November 21st in Nice, France.

Marcel will participate in the Monday afternoon session to discuss Efforts and Perspectives on Third Party Funding Regulation (“Tentatives et Perspectives de Régulation – Approche Comparée”). New York Arbitration Week to Take Place November 13th-November 17th

November 2023—The New York International Arbitration Center (NYIAC) and the New York Branch of the Chartered Institute of Arbitrators (CIArbNY) are pleased to continue their joint leadership for the fifth annual New York Arbitration Week taking place Monday, November 13th through Friday, November 17th in New York City. The theme, “New York, New York: A Celebration of New York Law and Arbitration” aims to highlight the deep and multifaceted connection between international arbitration and New York City by including a variety of topics that focus on New York’s connection not only with the practice of international arbitration but also with numerous global jurisdictions.

The New York Arbitration Week Organizing Committee consists of members from across the globe, reflecting NYAW’s goal of engaging with members of our international arbitration community in all regions. This year, the Committee is chaired by Chaffetz Lindsey’s Gretta Walters and White and Case’s Damien Nyer. In addition, Chaffetz Lindsey members David Blackman, May Khoury and Alicia Yeo are Secretaries to the Organizing Committee.

Monday, November 13th

Chaffetz Lindsey’s Lidia Rezende will participate in the Young Practitioners Panel & Networking Reception. During the event “Tales from the Hearing Room: ‘What Would You Do?’” panelists will share stories from practice about unique and unpredictable moments from the hearing room and then survey the audience to ask the simple question – “What would you do?” – before sharing how the story really ended.

Lidia will join Travis Gonyou (Binder & Schwartz), Ryan Lax (Torys) and Ricardo Reyes (White & Case) for the discussion moderated by Maria Teder (Ellex Legal).

The interactive evening discussion is presented by CIArb’s Young Members Group, AAA-ICDR Young & International, CPR Young Leaders in ADR, and Young Canadian Arbitration Practitioners.

Chaffetz Lindsey’s Gretta Walters will moderate the panel “Procedures for Asserting and Evaluating Privilege Claims in International Arbitration.” The panel will explore questions using interactive hypotheticals and based on a report issued in October 2023 by the New York City Bar Association’s International Commercial Disputes Committee.  The panel members, Ulyana Bardyn (Eversheds Sutherland), Joseph E. Neuhaus (Sullivan & Cromwell), Kim J. Landsman (Independent Arbitrator), are the principal drafters of the report.

The event discussing privilege issues in international arbitration and arbitrating cryptocurrency disputes is presented by the NYAW Organizing Committee and the New York Bar Association’s International Commercial Disputes Committee and Arbitration Committee.

Chaffetz Lindsey’s Yasmine Lahlou will speak on the panel “Obtaining Evidence from Non-parties to an International Arbitration in a Post Section 1782 World.” Using two mock applications to take evidence under Section 7 of the Federal Arbitration Act, the program will explore the possibilities that Section 7 provides to parties to obtain evidence from non-parties in U.S. seated and foreign-seated arbitrations, explore the issues as they might be presented to arbitral tribunals and also to a judge who may be asked to enforce an arbitral subpoena issued under Section 7. A discussion will follow examining the opportunities and challenges when seeking non-party evidence in the United States.

Chaffetz Lindsey’s Aníbal Sabater will speak on the panel “Public Construction Contracts and Construction Arbitration.” This session will introduce attendees to the field of public construction contracts and will address issues such as: (i) how public construction contracts differ from private construction agreements depending on the jurisdiction including those seated in New York; (ii) the role arbitration places in connection with public construction agreements; and (iii) how the involvement of government entities affects the resolution of international construction disputes. This panel will also discuss options available for international infrastructure projects with a special focus on dispute boards and a discussion on the AAA-ICDR’s new Dispute Avoidance and Resolution Board Procedures and “Best Practices” for the DARB Process. The session will conclude with a presentation by Jus Mundi featuring their International Construction Arbitration report.

The David D. Caron Praelium, co-organised by Three Crowns LLP, Columbia Law School, and King’s College London, is an annual celebration of advocacy, with two leading international advocates deploying their oratorical and advocacy skills in the service of important current legal issues before a distinguished three-member tribunal.

The Praelium will take place in person at the Harmonie Club in New York City, NY, on Thursday, November 16, 2023.

Chaffetz Lindsey’s Gretta Walters will speak on the panel “Efficient, Effective and Expeditious Resolution of Technology Disputes.” The panel will consider the current efforts to address the needs of technology disputes, including AI.  In response to this need, the ICDR created a Global Working Group which undertook a global survey of more than 500 participants to study how arbitration and other forms of dispute resolution can best assist parties in resolving such disputes.  The Working Group will publish a consultation draft of its White Paper addressing its findings immediately before the conference.  The panel will be joined by those involved in the efforts by UNCITRAL and SVAMC to address technology disputes to share their perspectives.

Additional speakers include Shai Sharvit (Gornitzky), Patricia Shaughnessy (Stockholm University) and Steve Smith (Steve Smith ADR LLC). Kathleen Paisley (Ambos Law) and Maria Chedid (Arnold & Porter) will moderate.

Lidia Rezende to Speak at 2 Worlds Arbitration New York Conference

November 2023—Chaffetz Lindsey‘s Lidia Rezende will speak at the upcoming 2 Worlds Arbitration Conference in New York on Friday, November 10th. The second edition of the conference presented by the Arbitration Channel, Columbia Law School and NYU Law will take place November 9th-November 10th and will focus on the U.S. and Brazilian perspectives on the future of international arbitration.

Drew Poplinger to Speak on Fall ARIAS Conference Panel

November 2023—Chaffetz Lindsey’s Drew Poplinger will join the panel “Does London market reinsurance cover U.S. “all sums” losses?” during the 2023 Fall ARIAS Conference taking place November 9th-10th in New York City. The breakout session will be held once on Thursday afternoon and another on Friday morning.

Andrew will join Chris Foster (HFW) and Robert Hall (Hall Arbitrations) for a discussion moderated by Seema Misra (Arch Insurance Group). The group will discuss the May 2023 Second Circuit decision in the ICSOP v. Equitas case, which has since spawned a transatlantic debate. The recurring issue has significant implications for US cedents and London-market reinsurers facing traditional long-tail asbestos and environmental losses, as well as emerging perils like PFAS. The group will present both sides of the issue and explore related topics, including how it could be resolved in arbitration.
