Gretta Walters Speaks at the 38th AAA-ICDR – ICC – ICSID Joint Colloquium on International Arbitration

May 2024—Chaffetz Lindsey’s Gretta Walters spoke at the 38th AAA-ICDR – ICC – ICSID Joint Colloquium on International Arbitration on Tuesday, May 21st in Washington, D.C.

Gretta participated in the panel “Enter the Shark Tank: Judging the Most Impactful Innovations in Arbitral Practice” which brought together arbitrators and practitioners to share their proposals for innovative tools to modernize international arbitration— particularly with respect to time and cost. The session used a Shark Tank-style setup with panelists presenting pitches and judges deciding on their top choice. Guled Yusuf (Allen & Overy) and Katie Gonzalez (Cleary Gottlieb) joined Gretta as the pitchers while Eduardo Zuleta (Arbitration Chambers), Marinn Carlson (MCarlson Arbitration PLLC) and Theresa Coetzee (Marriott International) acted as judges.

For over forty years, the International Centre for Settlement of Investment Disputes, the International Chamber of Commerce International Court of Arbitration, and the International Centre for Dispute Resolution of the American Arbitration Association have co-sponsored the Joint Colloquium on International Arbitration. The Colloquium featured updates on trends and initiatives from the three institutions, interactive sessions on issues at the forefront of commercial and investment arbitration, and an opportunity to network with practitioners and arbitrators from around the world. Anibal Sabater to Join MIAS and Friends LATAM Tour 2024

May 2024—Chaffetz Lindsey’s Anibal Sabater will join the Miami Arbitration Society (MIAS) and Friends Second Annual LATAM Tour: Recent Trends and Developments in Commercial Arbitration in Mexico, Central America, Bolivia, Ecuador, Paraguay, Peru, Brazil, Guatemala, and Chile taking place on Wednesday, May 22nd.

MIAS and Friends LATAM Tour provides an update from leading practitioners in the region on the current state of arbitration. It will be a brief but substantive informational session covering legislative and judiciary developments, state disputes; changes in local regulations and institutional rules; enforcement and current trends. Among the group, Anibal will share “A New York Perspective: How commercial arbitration in LATAM appears from an external vantage point.”

Gretta Walters to Speak at 2024 American Bar Association International Law Section Annual Conference

May 2024—Chaffetz Lindsey’s Gretta Walters is set to speak in Washington, D.C. at the 2024 American Bar Association International Law Section Annual Conference on Friday, May 10th.

Gretta will join Luis M. Martinez (Vice President, International Centre for Dispute Resolution, American Arbitration Association) and Julia E. Sullivan (Law Office of Julia Sullivan) for the panel “The Use and Misuse of Artificial Intelligence in Dispute Resolution”.

The panel will delve into the profound impact of AI on dispute resolution, examining how this transformative technology is reshaping traditional processes. By exploring AI’s potential benefits, risks, and ethical considerations, attendees will gain valuable insights into navigating the evolving landscape of dispute resolution.

James Hosking Joins Panel Discussing “Impossibility” at XVIII International Arbitration Conference in Rio De Janeiro

May 2024—Chaffetz Lindsey’s James Hosking will speak at the upcoming XVIII International Arbitration Conference in Rio De Janeiro on Tuesday, May 14th.  The conference is focused on “Impossibility in International Arbitration.”

James will join Marie-Isabelle Delleur (Clifford Chance), Andrea Carlevaris (BonelliErede) and Leonardo De Campos Melo (LDCM) for the panel “Court Intervention in Situations Where the Arbitral Tribunal Cannot Exert Its Own Jurisdiction”, and will focus on court intervention in gathering evidence. Andre Marini (Gaillard, Banifatemi & Shelbaya Disputes) will moderate the discussion.

Anibal Sabater to Participate in 2024 AAA Higginbotham Fellows Program

May 2024—Chaffetz Lindsey’s Anibal Sabater will participate in an industry roundtable discussion at the American Arbitration Association’s Higginbotham Fellows Program on Wednesday, May 8th.

Anibal will join Dana MacGrath (Independent Arbitrator), Robin Abramowitz (Bond Schoeneck & King), Al Feliu (Feliu Neutral Services) and Angela Foster (Law Office of Angela Foster). Participants will hear from arbitrators in commercial, international, employment and construction about their experiences and caseloads.

James Hosking and Silvia Marroquin Speak at 2024 ARIAS Spring Conference

May 2024— Chaffetz Lindsey’s James Hosking and Silvia Marroquin are set to speak at the upcoming 2024 ARIAS Spring Conference taking place May 1st-May 3rd in San Juan, Puerto Rico. Chaffetz Lindsey’s Cia Moss is co-chair of the event.

Silvia Marroquin will join the panel “How Should Arbitrators Address Potential For Settlement With the Parties? Opportunities, Limits and Ethics” on Thursday, May 3rd.  The panel will address and interact with participants on what tools may or may not be appropriate toward fostering settlement and the appropriate times for such actions, including scheduling a “mediation window”, bifurcation of liability and quantum, inquiring whether the parties have discussed settlement, presenting panel questions meant to highlight the risks on both sides, “ArbMed” or “Med-Arb”, other party-agreed arbitrator participation in settlement efforts, ethical limits and approaches of the various arbitral institutions and rules. Additional panelists include David W. Ichel, (X-Dispute LLP), Elaine A. Caprio (Caprio Consulting) and Carlos A. Romero (Post & Romero LLP).

James Hosking will join Carolyn Thomas (AON) for “Hot Spots and Hot Policies: Political Risk Insurance in Today’s Volatile World” on Thursday, May 3rd. The panel will discuss the types of political risk insurance (PRI) available and interaction with other insurance lines, coverage and exclusion issues, and the application to “gray” areas like economic blockades. Speakers will also consider how the existence of PRI coverage may interact with claims brought under investment treaties for governmental expropriation and unlawful interference, as well as with other forms of risk mitigation. In addition, the panel will assess how PRI coverage may affect country risk for purposes of financial reporting and damages calculations.

Caline Mouawad to Speak at “Investment Arbitration and Climate Change” Virtual Book Launch

April 2024—Chaffetz Lindsey’s Caline Mouawad will take part in the upcoming virtual book launch of “Investment Arbitration and Climate Change” on Monday, April 8th from 12pm-1:30pm EDT. In this webinar, contributors to the recently published volume Investment Arbitration and Climate Change will discuss issues at the intersection between a State’s climate change initiatives and their potential impact on foreign investors.

Caline will examine how climate science may come into play at various stages of an investor-State arbitration relating to climate change issues.

Other speakers include Anja Ipp and Annette Magnusson, co-founders of Stockholm-based think tank Climate Change Counsel and the book’s editors as well as Oliver Hailes, assistant professor of law at the London School of Economics.

Caline Mouawad to Speak on ISDS Reform: Financing of a Standing Mechanism and an Advisory Center

April 2024—Caline Mouawad is set to speak at a side event of the 48th Session of UNCITRAL Working Group III on Tuesday, April 2nd. Caline will join the panel “ISDS Reform: Financing of a Standing Mechanism and an Advisory Center” with Colin Brown (Directorate General for Trade, European Commission), Ayse Lowe (Bench Walk Advisors LLC), Viren Mascarenhas (Milbank LLP), Ladan Mehranvar (Columbia Center on Sustainable Investment), and Giovanny Vega (National Defense Agency of the Colombian Government).

The group will discuss the creation of an advisory center and a standing multilateral mechanism for the resolution of international investment disputes. Panelists will debate the pros and cons behind these reforms, with the goal of understanding their true impact if implemented.

Gretta Walters to Join 19th Annual ICDR Y&I Coffee House Debate

March 2024— Chaffetz Lindsey’s Gretta Walters will speak at the 19th Annual ICDR Y&I Coffee House Debate in Vienna, Austria on Sunday, March 24th. Gretta and accompanying panelists Angela Bergman Evans (Mannheimer Swartling), José Antonio Casas Chavana (Galicia Abogados), Emily Brait (Baker McKenzie), Marc Krestin (Fieldfisher) and Pilar Álvarez (GBS Disputes) will debate the following propositions: i) Parties should not be allowed to add to or amend their claims after the first procedural order; and ii) Parties can agree to deviate from any provision in the arbitral rules.

The discussion will be moderated by Mark Kantor (Independent Arbitrator) and Patricia Shaughnessy (Stockholm University).

Anibal Sabater Teaches Harvard Oil & Gas Arbitration Masterclass

March 2024—Anibal Sabater will join the Harvard International Arbitration Law Students Association Masterclass Workshop Series on Tuesday, March 19th.

Anibal will teach a session titled “International Arbitration in the Oil & Gas Sector,” covering disputes in the historically most relevant sector – oil and gas – and discuss the current trends and challenges in the field.

The Masterclass Workshop offers Harvard Law School students an in-depth introduction to the practice of international arbitration by delving into specific challenges and risks for international arbitration in key economic sectors.
