GRETTA WALTERS TO SPEAK AT GEORGETOWN INTERNATIONAL ARBITRATION MONTH 2016

February 2016 – The annual Georgetown International Arbitration Month (GIAM) is taking place in Washington, D.C. this February, and this year’s theme is “Multistakeholder Views of International Arbitration.”

GIAM events take place in Washington, D.C. throughout the month of February and join practitioners, scholars, and students from around the world for a series of panels on emerging issues and trends facing the international arbitration community. GIAM 2016 features a series of panels on cutting-edge issues in commercial and investment arbitration, and other aspects of dispute resolution and trade. Owing to the ever-evolving nature of our field, this year’s GIAM will incorporate new perspectives on issues including representatives from the private sector and various governments.

Chaffetz Lindsey’s Gretta Walters will be speaking on Tuesday, February 9th alongside Rocio Digon, Alex Lo, and Danielle Morris.  The panel, taking place from 6:30 – 8:30 PM at WilmerHale’s DC office, will discuss “What Does an Arbitration Cost?”

Aníbal Sabater to Speak at 2016 ICDR Miami International Arbitration Conference

January 2016 – The International Centre of Dispute Resolution, the international division of the American Arbitration Association, has been at the forefront of international alternative dispute resolution (ADR). This year’s International Arbitration Conference in Miami celebrates and analyzes the ICDR’s accomplishments, while looking ahead to the future of the international arbitration field.

Chaffetz Lindsey partner Aníbal Martín Sabater is a faculty member for a panel on Thursday, January 28th at 4pm titled “The Lagging Acceptance of International Mediation.”  This session will discuss the interesting and growing practice of mediation in recent years and why it still lags behind arbitration. The panel will also examine how the international business community benefit more from this excellent tool.

Thomas J. Stipanowich, of the Straus Institute for Dispute Resolution, will be the Session Keynote Speaker, followed by a discussion to be led by additional faculty members Mercedes Tarrazon (Dispute Management; Barcelona) and Eduardo Zuleta (Gómez-Pinzón Zuleta; Bogotá). Edna Sussman of Sussman ADR will serve as the moderator.

CL Partners to Speak at 2016 ITA-IEL-ICC Joint Conference on International Energy Arbitration

January 2016 – Three premier institutions are joining forces to present a highly regarded energy arbitration program this week in Houston, Texas. The Institute for Transnational Arbitration (ITA), the Institute for Energy Law (IEL), and the International Court of Arbitration of the International Chamber of Commerce (ICC) have developed a program that will address the essential current influences on arbitration in the energy sector today.  Two Chaffetz Lindsey partners have been invited to speak at this event, which will take place January 14-15, 2016, at the Omni Houston Hotel.

On Thursday, January 14th at 4:00 pm, Jennifer Permesly will speak on cybersecurity and data privacy alongside Jonathan Fairtlough (Managing Director, Cyber Security and Investigations, Kroll, Los Angeles) and Melinda L. McLellan (BakerHostetler, New York) in a panel moderated by Robert Carlton (Haynes and Boone, LLP, Houston).  This session will analyze the impact of recent breaches of cybersecurity and data privacy on the arbitration community and discuss how such breaches can be avoided in the future.

On January 15th at 2:30 pm, Aníbal Sabater will speak at a panel session titled “Emergency Arbitrator Proceedings In Oil & Gas Disputes” alongside Rocío Digón (Managing Director and Counsel, ICC International Court of Arbitration, SICANA, Inc., New York) and Mark W. Friedman (Debevoise & Plimpton LLP, New York).  Moderated by Kevin O’Gorman, (Norton Rose Fulbright US LLP, Houston), this panel will discuss the utility emergency arbitrators can have in oil and gas cases, as well as what standards and procedures govern the granting of emergency relief.  Also up for discussion by this panel is whether courts can enforce emergency arbitrator rulings.

Aníbal Sabater Speaks in Madrid at EXPANSIÓN and ACCIONA ADR Event

Anibal_Expansion Event Photo_11.2015November 2015 – Expansión and Acciona joined forces to assemble a prestigious group of national and international experts, which took place at the Hotel InterContinental in Madrid on November 24, 2015.  The experts shared their experiences on using alternative dispute resolution mechanisms in the infrastructure and energy sectors, as these mechanisms are increasingly popular in global business practice for their efficiency and practicality. The event aimed to delve into the different existing ADRs, their application in the energy and infrastructure sectors, and key practices for successful implementation.

Chaffetz Lindsey partner Aníbal Sabater presented as an expert at this event.  His session addressed commercial arbitration in construction and energy in the United States.

James Hosking to Speak at 9th International Arbitration & Mediation Conference in Brazil

November 2015 –The International Centre for Dispute Resolution® (ICDR®), the international division of the American Arbitration Association® (AAA®), the Arbitration and Mediation Centre of the Brazil-Canada Chamber of Commerce (CAM-CCBC), and the Arbitration Centre of the American Chamber of Commerce (AMCHAM), São Paulo, are jointly hosting the 9th International Arbitration and Mediation Conference on November 18, 2015, in Rio de Janeiro, Brazil.  This year’s conference, which brings together in-house counsel and attorneys, experts, arbitrators, and mediators, will focus on the various types of industries–and the possible disputes that may arise–related to the Olympic Games to be held in Rio de Janeiro in 2016.

The program will focus not only on sports arbitration: additional sessions will cover international ADR best practices as they relate to licensing, construction, and infrastructure projects as well.

Chaffetz Lindsey partner James Hosking is a faculty member for a session titled “International Construction and Infrastructure Projects: The Latest Conflict-Management Options.”  The panel will focus on innovative tools to use in international arbitration and mediation of disputes stemming from construction and infrastructure projects.  Several members of the Chaffetz Lindsey team are involved in such disputes involving Brazil and many other jurisdictions.

James will be joined on the panel by Oliver J. Armas (Hogan Lovells LLP, New York); Tony Dymond (Debevoise & Plimpton LLP, London); Patricia D. Galloway (Pegasus Global Holdings,Inc., Cle Elum); and José Antonio Fichtner (Andrade & Fichtner, Rio de Janeiro). Mauricio Gomm Santos (Gomm & Smith PA, Miami) will serve as the moderator.

Steven Reisberg Speaks at the First Annual NYSBA/AAA Arbitration Competition

November 2015 – The NYSBA teamed up with the AAA to hold the most realistic arbitration experience for New York State Law student-participants.

The NYSBA/AAA Moot Arbitration Competition was held on November 13th and 14th at AAA/NYIAC’s office on 42nd Street in Manhattan. All of the participants arbitrated before the best arbitrators in the state of New York and received feedback from leading practitioners in the field. Additional networking and training sessions were offered to the the participants.

Chaffetz Lindsey partner Steven Reisberg participated on a panel discussing the preliminary conference that occurs at the first hearing with the arbitrators to set the schedule for the proceeding.

Peter Chaffetz and Steven Schwartz Speak at 2015 ARIAS Fall Conference

November 2015 – The 2015 ARIAS Fall Conference is taking place in New  York City this week.   At this year’s conference, Chaffetz Lindsey partners Peter Chaffetz and Steve Schwartz are each speaking on panels.

Steve’s panel, “Improving the Arbitral Process through Team Engagement: How Counsel, Arbitrators and Company  Representatives Can Make a Difference.” This session will focus on ways in which outside counsel, inside counsel and party arbitrators can work together as a team to make the reinsurance arbitration process, which is frequently criticized as too slow, too expensive and too unpredictable, work better for everyone.  Other presenters include Robert E. Sweeney, Jr., CNA and Sylvia Kaminsky, Arbitrator / Reinsurance Consultant.

Peter is speaking with Jan Woloniecki, of ASW Law Limited, on “Contract Avoidance under U.S., UK and Bermuda Law.”  They will lead a discussion on rescission and avoidance of reinsurance contracts, comparing New York, Bermudian and New English Law.

 

 

James Hosking Speaks at ICC Canada International Arbitration Conference

October 2015 – The 2015 ICC Canada International Arbitration Conference took place in Vancouver on October 22nd and 23rd.  This conference is held annually to discuss issues surrounding Canadian and international arbitration and best practices.

Chaffetz Lindsey partner James Hosking spoke on the “Ghosts of Proceedings Past” panel alongside Gerald Ghikas (Q.C., Ghikas Arbitration), Marek Krasula (ICC International Court of Arbitration/SICANA, Inc.), and Robert Wisner (McMillan LLP).  Sophie Nappert (3 Verulam Buildings, London) was the moderator.

Peter Chaffetz and Steven Reisberg Speak at 2015 IBA Annual Conference in Vienna

October 2015 – The International Bar Association is hosting its Annual Conference in Vienna this week.  More than 6000 delegates have converged upon the Austria Center Vienna to attend nearly 200 working sessions.  Two of Chaffetz Lindsey’s partners, Peter Chaffetz and Steven Reisberg, are speakers at the conference.

Steven was a panelist at the “Smarter ways to educate your court” session, held on Tuesday, October 6th (from 2:30pm to 5:30pm).  The panel, sponsored by the IBA’s Litigation Committee, discussed expert witnesses and questions surrounding the use of them in court, including: Do court-appointed experts have the expertise? Are party-appointed experts independent? What alternatives exist? The panel also discussed how to handle confidentiality and privilege, as well as cutting-edge methods of presenting evidence, such as 3D-animated videos.

The panel was chaired by Bettina Knoetzl (Wolf Theiss, Vienna, Austria) and Christopher Richter (Woods LLP, Montreal, Québec, Canada).  Additional panelists included:  Yvette Borrius (Höcker Advocaten, Amsterdam, Netherlands), Richard Briggs (Hadef & Partners, Dubai, United Arab Emirates), Caroline Edwards (Travers Smith, London, England), Robert Hunter (Herbert Smith Freehills LLP, London, England), Paul Oberhammer  (Vienna University Department of Civil Procedure Law, Vienna, Austria), and Thera van Swaay de Marchi  (Pinheiro Neto Advogados, São Paulo, Brazil).

Peter Chaffetz was a session co-chair and panelist at the “How to market a litigation department” workshop, held on Wednesday, October 7th (2:30pm to 5:30pm).  The panel, sponsored by the IBA’s Law Firm Management Committee, engaged panelists and attendees to discuss questions such as: What is the best way to market a dispute resolution department? What should it offer, how should it charge and what should be its brand? The panel included the marketing director of a global law firm and dispute resolution partners from a variety of firms around the world. Some in-house counsel also provided insights.  It was structured to be a highly interactive experience and, by the end of the session, everyone was armed with ideas to make their business development efforts more effective.

Peter’s co-chairs of the session were Michael Hales (Minter Ellison, Perth, Western Australia, Australia), Matt McCahearty (Macfarlanes LLP, London, England).  Additional panelists included: Shawn Chen (HSBC, London, England), Myra Garrett (William Fry, Dublin, Ireland), Damian Morris (ICAP PLC, London, England), Laurie Robertson (Baker & McKenzie, London, England), Pedro Soares Maciel(Lefosse Advogados, São Paulo, Brazil), and Alvin Yeo (WongPartnership LLP, Singapore).

Chaffetz Lindsey Hosts ICC Young Arbitrators Forum Event

October 2015 – Chaffetz Lindsey and the ICC Young Arbitrators Forum co-hosted a panel on In Defense of International Commercial Arbitration:  Lessons to be Learned or Ignored from Investor-State Arbitration on September 29th, 2015.  Over 60 people turned out to discuss and debate recent developments in the investor-state dispute resolution system and the impact of these developments on international commercial arbitrations.

Yasmine Lahlou, Partner at Chaffetz Lindsey LLP, provided opening remarks, discussing the recent controversy surrounding the adoption of trade agreements in the U.S, Asian and Pacific countries, and the E.U.  The panel then explored transparency, issue conflict, and corruption issues, as they have arisen in investor-state arbitrations, and offered insight as to how these issues can be addressed in commercial arbitrations.  The panel consisted of Christian Hioureas, Associate at Chadbourne & Park LLP; Aloysius (Louie) Llamzon, Associate at King & Spalding LLP; Ruth Teitelbaum, Senior Associate at Freshfields Bruckhause Deringer LLP; and Gretta Walters as moderator, Associate at Chaffetz Lindsey LLP.

JAMES HOSKING PART OF FACULTY FOR ITALIAN COURSE IN INTERNATIONAL ARBITRATION

September 2015 – James Hosking will again serve as a lecturer for the certificate program in International Commercial and Investment Arbitration Theory and Practice run at Roma Tre Universita Degli Studi, and sponsored by the International Chamber of Commerce, Italian Arbitration Association, and Milan Chamber of Arbitration. The week-long course will be attended by a mix of law students, practitioners and in-house counsel and is intended as an intense introduction to international commercial and investment arbitration. The course will be run with support from leading international and domestic law firms, as well as arbit (the Italian Forum for Arbitration and ADR) and the Italian Ministry of Justice. James will speak on extending the arbitration agreement in the context of multi-party arbitration.

Aníbal Sabater to Speak at 10th ICC NY Conference

September 2015 – To commemorate the tenth year of the ICC New York Conference, members of the ICC Court and Secretariat, along with world-renowned practitioners, will lead an interactive discussion on the questions being asked in international arbitration today. This event, being held on September 21st, will feature a panel discussion on “Emergency Arbitrators: Is this institutional relief fulfilling its promise?”

Chaffetz Lindsey Partner Aníbal Sabater will speak on the panel along with Christian Leathley (Partner, Herbert Smith Freehills LLP, London), Ank Santens (Partner, White & Case LLP, New York), and Michael Young (Partner, Allen & Overy LLP, Paris).

The panel will address topics ranging from ICC emergency relief: recent ICC Court experience and new trends since the entry into force of the 2012 Arbitration Rules; choice of forum: strategic considerations as to whether emergency relief should be sought from institutions or domestic courts; emergency order and beyond: relevant standards to grant emergency relief and the enforceability of emergency orders in the face of party non-compliance.  The moderator will be Rocío Digón (Managing Director and Counsel, ICC International Court of Arbitration, SICANA, Inc., New York).
