Caline Mouawad to Speak at “Investment Arbitration and Climate Change” Virtual Book Launch

April 2024—Chaffetz Lindsey’s Caline Mouawad will take part in the upcoming virtual book launch of “Investment Arbitration and Climate Change” on Monday, April 8th from 12pm-1:30pm EDT. In this webinar, contributors to the recently published volume Investment Arbitration and Climate Change will discuss issues at the intersection between a State’s climate change initiatives and their potential impact on foreign investors.

Caline will examine how climate science may come into play at various stages of an investor-State arbitration relating to climate change issues.

Other speakers include Anja Ipp and Annette Magnusson, co-founders of Stockholm-based think tank Climate Change Counsel and the book’s editors as well as Oliver Hailes, assistant professor of law at the London School of Economics.

Caline Mouawad to Speak on ISDS Reform: Financing of a Standing Mechanism and an Advisory Center

April 2024—Caline Mouawad is set to speak at a side event of the 48th Session of UNCITRAL Working Group III on Tuesday, April 2nd. Caline will join the panel “ISDS Reform: Financing of a Standing Mechanism and an Advisory Center” with Colin Brown (Directorate General for Trade, European Commission), Ayse Lowe (Bench Walk Advisors LLC), Viren Mascarenhas (Milbank LLP), Ladan Mehranvar (Columbia Center on Sustainable Investment), and Giovanny Vega (National Defense Agency of the Colombian Government).

The group will discuss the creation of an advisory center and a standing multilateral mechanism for the resolution of international investment disputes. Panelists will debate the pros and cons behind these reforms, with the goal of understanding their true impact if implemented.

Gretta Walters to Join 19th Annual ICDR Y&I Coffee House Debate

March 2024— Chaffetz Lindsey’s Gretta Walters will speak at the 19th Annual ICDR Y&I Coffee House Debate in Vienna, Austria on Sunday, March 24th. Gretta and accompanying panelists Angela Bergman Evans (Mannheimer Swartling), José Antonio Casas Chavana (Galicia Abogados), Emily Brait (Baker McKenzie), Marc Krestin (Fieldfisher) and Pilar Álvarez (GBS Disputes) will debate the following propositions: i) Parties should not be allowed to add to or amend their claims after the first procedural order; and ii) Parties can agree to deviate from any provision in the arbitral rules.

The discussion will be moderated by Mark Kantor (Independent Arbitrator) and Patricia Shaughnessy (Stockholm University).

Anibal Sabater Teaches Harvard Oil & Gas Arbitration Masterclass

March 2024—Anibal Sabater will join the Harvard International Arbitration Law Students Association Masterclass Workshop Series on Tuesday, March 19th.

Anibal will teach a session titled “International Arbitration in the Oil & Gas Sector,” covering disputes in the historically most relevant sector – oil and gas – and discuss the current trends and challenges in the field.

The Masterclass Workshop offers Harvard Law School students an in-depth introduction to the practice of international arbitration by delving into specific challenges and risks for international arbitration in key economic sectors.

Gretta Walters to Speak at the 2024 IBA M&A Latin America Conference

March 2024—Gretta Walters is set to speak at the 2024 International Bar Association’s Mergers & Acquisitions in Latin America Conference on March 14th. Gretta will join Gabriel Mesa (Covington & Burling), Andrea Saffie (Cariola Diez Perez-Cotapos), Laura Sinisterra (Debevoise & Plimpton) and Jose Felix Zaldivar de la Rica (Uria Menendez) for the panel titled “Closing Litigation Issues: Controversies Related to the Use of Escrow Agreements, Representations and Guarantees, and Price Adjustment”.

The panel will:

  1. Explore how the overcrowding of justice systems in countries around Latin America plays a role in the lack of M&A related litigation;
  2. Discuss the preference by parties to M&A deals for arbitration, rather than domestic courts or alternative dispute resolution procedures;
  3. Discuss problems between parties where claims are more commonplace and frequently contested or challenged, including: post-closing indemnification, purchase price adjustments, concerns about escrow agreements and possible sums that may be retained;
  4. Explore mechanisms used for funding and securing an indemnity (ie, escrow agreements) and other mechanisms such as set-offs against future payments (particularly earn-out payments) and a partial holdback of the purchase price;
  5. Discuss and explore how tribunals have handled such situations.

Gretta Walters Gives Keynote Address at 17th Annual International Centre for Dispute Resolution® (ICDR) Practice Moot and Lecture Series

March 2024—Gretta Walters gave the keynote address at the 17th Annual International Centre for Dispute Resolution® (ICDR) Practice Moot and Lecture Series that took place on Friday, February 16th.

Gretta’s speech, “When Arbitrators’ and Institutions’ Authority Clash”, took a practical examination of one of the issues of this year’s Vis moot problem.

Each year, the program brings together preeminent arbitrators and practitioners in the field of international commercial arbitration with the aim of helping law students from around the world sharpen their advocacy skills in anticipation of the Willem C. Vis International Commercial Arbitration Moot competitions held in Vienna and Hong Kong.

Andy Frischknecht to Speak on 2024 Transatlantic Legal Conference Panel “Attorney Client Privilege Reloaded” in Frankfurt

February 2024 — Chaffetz Lindsey’s Andy Frischknecht will speak as a panelist at the upcoming Transatlantic Legal Conference at the Institute for Law and Finance in Frankfurt on March 1st, 2024. At the conference, organized by the German-American Lawyers’ Association (DAJV), experts from Germany and the US in working groups including Arbitration, Litigation, Mediation (ALM), and Mergers and Acquisitions (M&A), will tackle current topics and cases of transatlantic relevance.

Andy will be speaking on the panel “Attorney Client Privilege Reloaded,” moderated by Dr. Anke Meier (Noerr), with Max D. Stein (Skadden, Arps, Slate, Meagher & Flom). The panel will address a range of issues, including choice of law and waiver, and explore how to avoid common privilege pitfalls in cross-border litigation.

May Khoury to Speak on ICC YAAF Panel in Dubai

February 2024—Chaffetz Lindsey’s May Khoury will join the upcoming the ICC Young Arbitration & ADR Forum (YAAF) event taking place in Dubai on February 28th. The event “Wrestling the Leviathan – Illegality and Corruption in Arbitration” takes place parallel to the 12th ICC MENA Conference on International Arbitration and will feature an interactive discussion on illegality and corruption issues in international arbitration.

Practitioners from diverse jurisdictions will address questions on the subject, such as the difference between illegality and corruption, the arbitrability of corruption allegations, the burden and standard to prove corruption in arbitral proceedings, public policy considerations, sua sponte investigation of corruption issues by arbitral tribunals, the sanctions available to arbitrators, and how practitioners can best address these issues in practice.

May will join the panel composed of Yacine Francis (Allen & Overy), Rami Chahine (Meltem Avocats), Salma Abdelaziz (Meysan Partners) and Fakhruddin Valika (ICC International Court of Arbitration).
