James Hosking and Matthew Draper Explain New Korea-United States FTA

March 2012 – Partner James Hosking and Senior Associate Matthew Draper co-author an article with Korean law firm Yulchon on the new Korea-United States Free Trade Agreement, which entered into force on March 15, 2012.

The agreement is primarily focused on expanding trade between the countries by reducing tariffs and other barriers. It also establishes minimum standards of treatment for investments and investors, and includes a mechanism by which an aggrieved investor can seek compensation from the host state for any breach of these standards. Their article explains the protections available to investors under the agreement and proposes steps companies should take to ensure their investments are properly covered.
